The Borough of Denver ("Borough") shall enter into an agreement with
the Township of East Cocalico ("East Cocalico") with respect to the furnishing
by the East Cocalico Township Police Department of police protection services
to the Borough (the "agreement"), which agreement is incorporated by reference
with the same effect as if the agreement had been set forth verbatim in this
section. A copy of the agreement shall be filed with the minutes of the meeting
at which this article is enacted.
The President or Vice President of the Borough Council and the Secretary,
respectively, of the Borough are authorized and directed to execute, to attest
and to deliver the agreement, on behalf of this Borough, substantially in
the form presented at this meeting.
The Borough Council of Denver Borough is authorized to take such other
action as may be necessary to carry out the purposes of this article in connection
with the implementation of the agreement.
As required by the Intergovernmental Cooperation Act, the following
matters are specifically found and determined:
A. The conditions of the agreement are that East Cocalico,
for an agreed upon price, will furnish police protection services to the Borough
of Denver of the same caliber and scope as those furnished in East Cocalico.
B. The agreement will commence on January 1, 1995, and will
continue until December 31, 1996. Either party may terminate the agreement
by giving three months written notice to the other party prior to the expiration
of the agreement or any renewal thereof. Failure to give such notice shall
cause the agreement to renew automatically on a calendar year basis. Either
party, in addition to the foregoing, may terminate the agreement at any time
by giving six months written notice to the other party and, in such event,
a pro rata adjustment will be made to the contract price for any portion of
the contract year during which police services are not to be rendered by East
Cocalico to the Borough of Denver.
C. The purpose and objectives of the agreement are to provide
police protection services to the Borough.
D. The manner and extent of financing the agreement are
that no borrowing will be required and all funds needed to make payments in
accordance with the agreement shall be paid from the general revenues of the
Borough.
E. There is no organizational structure necessary to implement
the agreement.
F. The agreement does not contemplate the acquisition, management
or disposal of any real or personal property other than the sale of some or
all of the personal property formerly used by the Borough Police Department
to East Cocalico for a price to be agreed upon after examination and evaluation
of such personal property by East Cocalico.
G. East Cocalico Township is empowered to
enter into contracts for policies of group insurance and employee benefits.
