From and after the passage of this article it
shall be unlawful for any person to:
A. To pollute the reservoirs, springs or water supply
or other portions of the water system.
B. To damage any part of the water system.
C. To willfully or negligently allow to flow unnecessarily
from the private system in his, her, its or their building or buildings.
D. To open a fire hydrant, water valve or stop cock,
forming a part of the water system, on any occasion whatsoever, except
at the request of a member of the Water Committee or the Superintendent,
or in case of fire.
E. To vacate any building to which water is being supplied contrary to §
196-19 herein.
F. To refuse access to the Water Superintendent or a
Borough employee to the consumer's premises either for the purpose
of reading the water meter or for the purpose of examining the private
system therein installed.
G. To make a meter inaccessible to the Water Superintendent or a Borough employee contrary to §
196-17.
H. To tamper with, break or destroy any water meter, contrary to §
196-17.
I. To change the location of any water meter.
J. To make a connection to the water system without first
having obtained a connection permit.
K. To use water from the water system for other than necessary human consumption and sanitary domestic needs in defiance of a proclamation of the Mayor in accordance with §
196-18.
L. To install, maintain, or allow to be installed or
maintained any cross-connection.

M. To fail to install or maintain a backflow preventor where Article
VI of this chapter requires installation of a backflow preventor.

N. To fail to inspect backflow preventor where Article
VI of this chapter requires installation of a backflow preventor.

O. Failure to comply with any provision of Chapter
196 of the Code of the Borough of Denver.

A. Any person
who shall violate any provision of this article shall, upon conviction
thereof, be sentenced to pay a fine not exceeding $1,000 and costs,
and in default of payment thereof, shall be subject to imprisonment
for a term not to exceed 30 days. Each day that a violation of this
article continues shall constitute a separate offense. Upon summary
conviction or in a civil action, the defendant may be assessed reasonable
attorneys' fees incurred by the Borough in the enforcement proceeding
in accordance with § 3321(6) of the Borough Code, codified
at 36 PS § 3321.
B. Should
any person or entity violate any provision of this chapter, the Borough
may proceed to enforce compliance through an action in equity in the
court of common pleas in accordance with the Borough Code codified
at 36 PS § 3321.
C. Any violation of Chapter
196 that jeopardizes the safety of the water system, including the prevention of backflow into the water system and failure to allow inspections of backflow preventers, shall subject the violator to termination of water service from the water system.
D. The remedies
set forth herein are cumulative and nonexclusive; the Borough reserves
the right to utilize any one or all of the foregoing remedies individually
or simultaneously.
