The acts prohibited herein are hereby declared to constitute a public
nuisance which, unless controlled, constitutes a serious threat to the health,
safety and welfare of the citizens of East Cocalico Township.
For the purposes of this article the following definitions shall apply:
DISPOSE
Includes the storage, collection, disposal, burying or handling of
dead animals, including fowl.
OWNER
Any person who alone or jointly or severally with others:
A.
Shall have legal title to any property, dwelling or dwelling unit, with
or without accompanying actual possession thereof; or
B.
Shall have charge, care, or control of any property, dwelling or dwelling
unit, as owner or agent of the owner, or an executor, administrator, trustee,
or guardian of the estate of the owner. Any such person thus representing
the actual owner shall be bound to comply with the provisions of this article
and of the rules and regulations adopted pursuant thereto, to the same extent
as if he were the owner.
VECTOR
A rodent, arthropod, or insect capable of transmitting a disease
or infection. Vectors shall include, but not be limited to, rats, mosquitoes,
cockroaches, flies, ticks, fleas, etc.
Any person who violates or permits a violation of this article shall,
upon conviction in a summary proceeding brought before a Magisterial District
Judge under the Pennsylvania Rules of Criminal Procedure, be guilty of a summary
offense and shall be punishable by a fine of not less than $100 nor more than
$1,000, plus costs of prosecution. In default of payment thereof, the defendant
may be sentenced to imprisonment for a term not exceeding 90 days. Each day
or portion thereof that such violation continues or is permitted to continue
shall constitute a separate offense, and each section of this article that
is violated shall also constitute a separate offense.
