As part of this chapter, all state-designated wetlands in the Town of Woodstock, as of the date of this chapter, shall be deemed critical environmental areas. (See Appendix A.[1]) Additional critical environmental areas may be designated from time to time by resolution of the Town Board in consultation with the WEC in accordance with provisions of § 14(g) of Part 617.

A. 
For the purposes of this chapter, Type I actions include all those given in § 4 of Part 617. Additional actions may be designated as Type I from time to time by resolution of the Town Board in consultation with the WEC, under provisions of § 4 of Part 617.
B. 
In addition, the following thresholds for Type I actions in § 4 of Part 617 shall be altered as follows for the Town of Woodstock:
(1) 
Construction of new residential units which meet or exceed the following thresholds:
(a) 
Units not to be connected to existing community or public water and sewerage systems, including sewage treatment works [§ 4(b)(5)(ii) of Part 617]:
[1] 
State: 50 units.
[2] 
Woodstock: 12 units.
(b) 
Units to be connected in existing community or public water and sewerage systems, including sewage treatment works [§ 4(b)(5)(iii) of Part 617]:
[1] 
State: 250 units.
[2] 
Woodstock: 15 units.
(c) 
Units to be connected to a proposed common, private or public central water/sewer system, including a sewage treatment facility established after the passage of this chapter:
[1] 
Woodstock: six units.
(2) 
Activities, other than the construction of residential facilities, which meet or exceed any of the following thresholds, or the expansion of existing nonresidential facilities by more than 50% of any of the following thresholds:
(a) 
A project or action which involves the physical alteration of [§ 4(b)(6)(i) of Part 617]:
[1] 
State: 10 acres.
[2] 
Woodstock: five acres.
(b) 
A project or action which would use groundwater or surface water per day in excess of [§ 4(b)(6)(ii) of Part 617]:
[1] 
State: 2,000,000 gallons.
[2] 
Woodstock: 5,000 gallons.
(c) 
Parking for [§ 4(b)(6)(iii) of Part 617]:
[1] 
State: 1,000 vehicles.
[2] 
Woodstock: 50 vehicles.
(d) 
A facility with more than the following square feet of gross floor area [§ 4(b)(6)(iv) of Part 617]:
[1] 
State: 100,000 square feet.
[2] 
Woodstock: 10,000 square feet.
C. 
For the purposes of this chapter, additional Type I actions shall include:
(1) 
The creation of, or increase by more than 25% in gross area of, a light industrial district or facility.
(2) 
Soil, gravel, sand or rock extraction or mining operations requiring a permit in accordance with the Chapter 260, Zoning, § 260-63A of this Code.
(3) 
Construction or placement of cement plants or batch plants.
(4) 
Airborne application of herbicides and/or pesticides.
(5) 
Construction or placement of commercial microwave transmitting and receiving antennas.
(6) 
Construction, placement or modification of personal wireless services and personal wireless facilities.

(7) 
Special permit for nonresidential use in a residential area consisting of 5,000 square feet or more of building area.
(8) 
An unlisted action undertaken in a critical environmental area.
A. 
For purposes of this chapter, Type II actions include all those listed in § 5 of Part 617.
B. 
Additional Type II actions may be designated from time to time by resolution of the Town Board in consultation with the WEC, under the provisions of § 5 of Part 617.
The WEC shall make a yearly report to the Town Board of the Town of Woodstock regarding the effectiveness of this chapter and shall make recommendations for revisions as needed.
This chapter takes effect immediately upon filing in the office of the Secretary of State in accordance with § 27 of the Municipal Home Rule Law. A copy of this chapter must be filed with the Commissioner of the Department of Environmental Conservation.
