The office of Code Enforcement Officer is hereby
established in and for the Village of Liberty, Sullivan County, New
York, who shall be appointed by the Village Board of Trustees of the
Village of Liberty ("Village Board") for a term of up to one year,
to serve at the pleasure of the Village Board at a compensation to
be fixed and determined from time to time by the Village Board.
In the absence of the Code Enforcement Officer
or in case of the Code Enforcement Officer's inability to act for
any reason, the Village Board may designate a person to act on behalf
of the Code Enforcement Officer and to exercise all the powers conferred
upon the Code Enforcement Officer by this chapter and any other law,
ordinance, code, rule or regulation.
The Village Board, with the approval of the
Code Enforcement Officer, may appoint one or more code enforcement
officers, as the need may appear, to act under the supervision and
direction of the Code Enforcement Officer and to exercise any portion
of the powers and duties of the Code Enforcement Officer as directed
by him or her. The compensation of such code enforcement officer(s)
shall be fixed by the Village Board.
A Code Enforcement Officer or an officer or
employee of the Building Department shall not engage in any activity
inconsistent with the Code Enforcement Officer's duties or with the
interests of the Building Department, nor shall the Code Enforcement
Officer, during the term of his or her employment, be engaged directly
or indirectly in any building business or in the furnishing of labor,
materials, supplies or appliances for, or the supervision of, the
construction, alteration, demolition or maintenance of a building
or the preparation of plans or specifications therefor within the
Village of Liberty, except that this provision shall not prohibit
any employee from engaging in any such activities in connection with
the construction of a building or structure owned by the employee
for the employee's own personal use and occupancy or for the use and
occupancy of members of the employee's immediate family and not constructed
for sale.
