Each police officer and the Animal Control Officer shall apprehend any dog running at large contrary to the provisions of this chapter.
The police officer or Animal Control Officer who apprehends and impounds a dog shall keep record of each dog apprehended and impounded. The record, as kept and maintained by the police officer and the Animal Control Officer, shall include for each apprehended and impounded the time, date, and place of apprehending and impounding, the breed, if ascertainable, the color, the sex, the number and the state dog tag, if any, and the date and time delivered to the Delaware SPCA.
A compilation of the records setting forth the information required shall be maintained at the office of the Town Clerk at the Town Hall.
The Animal Control Officer shall post in Town Hall and give notice to the owner, if ascertainable, by certified mail, with return receipt requested, within 72 hours from the time that the dog is apprehended and impounded. Such notice shall contain the information required to be kept and maintained by the Town in accordance with the preceding section.
Any dog found running at large contrary to the provisions of this chapter may be delivered to the Board of Game and Fish Commissioners of the State of Delaware or any agent thereof for impounding and disposal under the rules and regulations adopted by it.
Individuals who choose to apprehend a feral cat running at large within the Town of Milton shall have the feral cat delivered to the Delaware SPCA or, after proper spay or neutering, the feral cat may be released back onto the property of capture.
No individual will trap a feral cat off their property of record except the Cat Snippers of Milton pursuant to specific authorization from Town Council.
