A. It shall be unlawful for any person or entity to operate
a taxicab to pick up a passenger or passengers for hire within the
Village of Liberty without obtaining a taxicab driver's license therefor.
B. The annual fee for a taxicab driver's license is hereby
fixed at $40 per year. In addition, the following shall apply:
(1) In addition to the annual fee, any person applying
for a taxicab driver's license for the first time shall pay a nonrefundable
initial application fee of $40 at the time the application is submitted.
(2) An application fee of $25 shall be submitted when
a renewal application is filed, which fee is nonrefundable but is
calculated as part of the yearly fee.
C. Before a taxicab driver's license is issued as hereinafter
provided, each applicant must comply with the following to the satisfaction
of the Chief of Police:
(1) Exhibit a regular New York State chauffeur's license,
together with two photographs taken within 30 days of the initial
application, one of which is to be of a front view and the other of
which is to be of a side view, together with the applicant's fingerprints;
(3) Be sound physically and have good eyesight;
(4) Must not have a reputation of being addicted to the
use of intoxicating liquors or drugs;
(5) Must be of good moral character;
(6) Fill out, upon a form to be provided by the Village
Clerk, a statement giving the following information, which statement
shall be signed and sworn to by the applicant and filed with the Village
Clerk as a permanent record.
(c)
Place of residence for five years previous to
his or her moving to his or her present address;
(i)
Length of time he or she has resided at his
or her last place of residence;
(j)
Whether a citizen of the United States;
(k)
Places of previous employment;
(l)
Whether he or she has ever been arrested or
convicted of a felony or misdemeanor;
(m)
Whether he or she has been previously licensed
as a taxicab operator or chauffeur and, if so, whether his or her
license has ever been revoked or suspended and for what cause; and
(n)
The number of the chauffeur's license issued
by the State of New York.

A. Upon satisfactory fulfillment of the forgoing requirements,
there shall be issued to the applicant a taxicab driver's license
by the Village Clerk. All taxicab driver's licenses shall be numbered
in the order in which they are issued and shall contain the name and
place of residence of the licensee and the date of issuance and expiration
of the taxicab driver's license, which taxicab driver's licenses shall
be issued as of May 31 in each and every year and shall be valid to
and including May 30 of the next succeeding year, unless previously
suspended or revoked.
B. The Village Clerk may renew a taxicab driver's license
from year to year by appropriate endorsement thereon, and such renewal
application shall be made within not less than 30 days next preceding
its expiration, upon a form to be furnished by the Village Clerk,
giving such information as the appropriate officials of the Village
deem necessary.
C. Any taxicab driver's license or renewal thereof may
be suspended, pending a hearing before the Village Board of Trustees,
by the Mayor or revoked for cause after a hearing by the Village Board
of Trustees, in which event the taxicab driver's license shall be
forthwith returned to the Village Clerk, and no licensee whose taxicab
driver's license or renewal thereof has been revoked shall be licensed
as a taxicab driver in the Village of Liberty unless upon presentation
of reasons satisfactory to the Village Board. Any false statement
of a material fact in the application shall be sufficient cause for
the immediate suspension and/or revocation of the taxicab driver's
license. A suspension shall be effective until the matter is heard
and determined by the Village Board.

A. The failure to comply with any of the provisions of
this article shall be and constitute a violation thereof, and any
person violating any provision of this article shall forfeit and pay
a penalty and fine of no more than $250 for the first violation thereof
and no more than $500 for each subsequent violation. Each day that
the violation continues shall be deemed a separate violation. The
court may, in addition to or in lieu of a fine, impose a suspension
or revocation of the taxicab driver's license.
B. An owner who allows a person to operate a taxicab
who does not have a valid taxicab driver's license shall forfeit and
pay a fine and penalty of no more than $250 for the first violation
thereof and no more than $500 for each subsequent violation. Each
day that the violation continues shall be deemed a separate violation.
The court may, in addition to or in lieu of a fine, impose a suspension
or revocation of the taxicab permit issued for the taxicab involved
in the incident.
The foregoing local law shall take effect immediately
after due publication thereof.
