The following words and terms, when used in
this chapter, shall have the following meanings, unless the context
clearly indicates otherwise:
AIR GAP
The unobstructed vertical distance through the free atmosphere
between the lowest opening from any pipe or faucet supplying water
to a tank, plumbing fixture or other device and the flood level rim
of the receptacle.
BACKFLOW
The flow of water or other liquids, mixtures or substance
into the distributing pipes of a potable supply of water from any
source or sources other than the approved source.
CONTAMINATION
Any physical, chemical or biological substance present in
the pool water which may adversely affect the health or safety of
the bather.
CROSS CONNECTION
Any physical arrangement connecting a:
A.
Potable water system, directly or indirectly,
with anything other than another potable water system; or
B.
A swimming pool or spa pool to any potable or
nonpotable water source capable of contaminating the pool as a result
of backflow.
DEPARTMENT
The Community Development Department of Radnor Township.
D.E.R.
The Pennsylvania Department of Environmental Resources.
DIRECTOR
The Community Development Director or duly authorized representative.
LIFEGUARD
A person appointed by the owner or manager to maintain surveillance
over the bathers on the deck or in the pool and to supervise bather
safety. The lifeguard shall meet the training requirements of this
chapter.
OWNER
Any person, agent, firm or corporation having a legal or
equitable interest in a public bathing place and responsible for the
continual operation and maintenance of such facility in accordance
with the terms of this chapter.
PLUMBING CODE
The BOCA National Plumbing Code, published by the Building
Officials and Code Administrators International, Inc.
PUBLIC BATHING PLACE
Any outdoor or indoor place used for amateur, professional
or recreational swimming or relaxation, to include a swimming pool,
spa pool or wading pool, whether or not a fee is charged for the admission
or use of such facility. This definition is exclusive of a swimming
pool, spa pool or wading pool at a single- or two-family residence
which is used solely by the owner of the residence, family and personal
guests.
REFUSE
All nonputrescible wastes generally regarded and classified
as rubbish, trash or junk or by similar designations which have been
rejected by the owner or possessor thereof as useless or worthless
to him.
SEWAGE
Any substance which contains any of the waste products or
excrements or other discharges from the bodies of human beings or
animals and any noxious or deleterious substance being harmful or
inimical to the public health or to animal or aquatic life or to the
use of water for domestic water supply or for recreation.
SEWERAGE SYSTEM
Any community or individual system, whether publicly or privately
owned, for the collection and disposal of sewage or industrial wastes
of a liquid nature, including various devices for the treatment of
such sewage or industrial wastes.
SOURCE
A well, spring, cistern, infiltration gallery, stream, reservoir,
pond or lake from which, by any means, water is taken, either intermittently
or continuously, for use by the public.
SPA POOL
Any whirlpool, hot-tub or similar device, other than a residential
spa or hot tub, which is designed for relaxation or recreational use,
where the user is sitting, reclining or at rest and the pool is not
drained, cleaned or refilled after each use, which shall include but
not be limited to hydrojet circulation, hot water, cold water or mineral
baths or air-induction bubbles, in any combination, and is operated
by the owner, regardless of whether a fee is charged. Public spas
and hot tubs may be individual units or may be integrated into a larger
swimming pool or bathing pool. A public "spa pool" may, depending
on its size, accommodate one or more persons. "Spa pools" used in
connection with a licensed medical practice, under the direct supervision
of qualified medical personnel, shall be excluded from the requirements
of this chapter.
SWIMMING POOL
Any structure, basin, chamber or tank containing an artificial
body of water for swimming, diving, relaxation or recreational bathing
and having a depth of two feet or more at any point and including
all associated facilities, but shall not include a spa pool.
TOWNSHIP
The Township of Radnor, Delaware County, Pennsylvania.
TURNOVER PERIOD
The minimum time necessary to circulate the entire volume
of the pool facility through the treatment system.
WADING POOL
Any artificial pool of water less than two feet deep and
intended for wading purposes.
WATERS OF THIS COMMONWEALTH
Rivers, streams, creeks, rivulets, lakes, dammed water, ponds,
springs and all other bodies of surface and underground water or parts
thereof, whether natural or artificial, within or on the boundaries
of this commonwealth.
WATER SUPPLY
A source or sources of water, as well as any and all water
treatment, storage, transmission and distribution facilities.
