This chapter shall be known as the "Recreational
Area Law" of the Town of Greece.

The Town of Greece has established recreational
areas to be administered by the Department of Public Works. For the
better management of these recreational areas, it is necessary to
establish certain rules and regulations for all persons entering,
using, and visiting or who are otherwise within the boundaries of
said recreational areas.
As used in this chapter, the following terms
shall have the meanings indicated:
PERSON
Any individual, firm, partnership, corporation or association
of persons, and the singular number shall include the plural.
RECREATIONAL AREAS
All parks, playgrounds, athletic fields, boat-launching ramps,
all areas between the ends of highways and tidal waters and other
recreational areas, including approaches, driveways, parking areas
and buildings and structures located thereon, owned, leased or operated
by the Town of Greece.
TOWN SUPERVISOR
The chief elected executive officer and administrative head
of the Town government or his/her duly authorized agent or representative.
VEHICLE
Any vehicle which is or may be mounted on wheels and is or
may be propelled, either by its own power or by another power-driven
vehicle to which it may be attached. The term shall include any trailer
of any size, type or description.

The Commissioner of Public Works shall be authorized
to otherwise set down rules and regulations that he/she may deem proper
to maintain the safety and welfare of those persons using Town recreational
areas as defined herein.

Recreational areas shall be open to the public
at such periods and during such hours as shall be fixed by resolution
of the Town Board. It shall be the duty of the Commissioner of Public
Works to post notices of the opening and closing hours in each recreational
area.
A. Hours of operation of recreation. The Commissioner
of Public Works shall have the authority to extend the hours of access
to the confines of the recreational areas when, in judgment of the
Commissioner, public interest demands it. Official park hours of operation
are 9:00 a.m. to 10:00 p.m., with the exception of Braddock Lodge/Pavilion,
which is open from 10:00 a.m. to 10:00 p.m.
B. In case of an emergency or when, in the judgment of
the Town Board, the Supervisor or the Commissioner of Public Works,
the public interest demands it, any portion of a park may be closed
to the public or to designated persons until permission is given to
reopen.
No person shall take part in or abet the playing
of any games involving thrown or otherwise propelled objects, such
as balls, stones, arrows, javelins or model airplanes, except in areas
set apart for such forms of recreation. The playing of active sports
or games such as football, baseball, soccer, basketball and rugby
are prohibited except on the fields and courts or areas provided therefor.
The playing of golf is prohibited in all areas.

A. No person shall:
(1) Use any drugs except as prescribed by a duly sworn
doctor of medicine.
(2) Hold the Town of Greece liable for any alcohol/drug-related
incident that occurs within any recreational area.
B. Alcohol use and/or consumption. Beer and wine only
are allowed by issuance of a permit by the Constituent Services Department.
If consumed, it must be done within the confines of the New York State
Alcoholic Beverage Control Act.

No person shall hunt, trap or pursue wildlife
at any time in a recreational area. No person shall use firearms of
any description or air rifles, spring guns, bow and arrows, slings
or any other forms of weapons potentially harmful to wildlife and
dangerous to human safety or any instrument that can be loaded with
fire blank cartridges or any kind of trapping device. Shooting into
recreational areas from beyond their boundaries is forbidden. (This
does not include the fish and wildlife management area outside of
the developed Braddock Bay Park area.)

Any law enforcement officer may arrest any person,
in any recreational area, who has violated any of the provisions of
this chapter or any rules or regulations.

A. Violation. Any person convicted of a violation, as
set forth in this chapter, shall be subject to a fine of no more than
$500 and/or imprisonment not to exceed 15 days, in addition to the
above.
B. Restitution; reparation; services to the Department
of Public Works. Any person convicted of a violation of the provisions
of this chapter shall be subject to the provisions of § 65.10
of the New York State Penal Law and § 758-A of the New York
State Family Court Act relative to the making of restitution, reparation
for loss or damages and the performing of services for a public agency
or for the public good, which in such case shall include appropriate
services for the Department of Public Works of the Town of Greece.

C. Parents or legal guardians. Parents or legal guardians
of youths over 10 years of age and less than 18 years of age shall
be liable for damages or destruction caused in the Town of Greece
recreational areas by such youths, pursuant to the provisions of § 3-112
of the New York State General Obligations Law and other laws governing
the same.
D. Damages to recreational area property. In addition
to any penalties prescribed herein, any person causing damage to park
or recreational property, real or personal, shall be liable to the
Town of Greece for such damage.
