The Director of Public Works, Superintendent
of Public Works/Village Engineer, Building Inspector or other code
enforcement officer shall report any violation of this article to
the Traffic Commission, and if the Traffic Commission agrees, the
Director of Public Works may, by notice of at least 15 days mailed
to the owner or owners of such tree, shrub, fence, wall or other structure,
order such owner or owners, on or before a date fixed in such notice,
to cause such tree, shrub, fence, wall or other structure to be removed
or so trimmed so that it shall cease to be a violation.
[Amended 12-15-1992 by L.L. No. 2-1992]
In case such owner or owners shall fail to cause
such tree, shrub, fence, wall or other structure to be removed or
so trimmed on or before such date, the Director of Public Works shall
report to the Village Administrator, who shall direct the Director
of Public Works to have the tree, shrub, fence, wall or other structure
removed. The cost of such removal shall be the obligation of the property
owner and shall become a lien on the property, to be collected in
the same manner as a Village tax. This provision with respect to costs
shall be in addition to any penalties imposed for violation of or
noncompliance with the provisions of this chapter.
[Amended 12-15-1992 by L.L. No. 2-1992]
Any such owner or owners (including any individual, partnership or corporation owning such tree, shrub, fence, wall or other structure, alone or in common with another or others) who shall fail to comply with an order made pursuant to this article or shall resist or obstruct the Director of Public Works or any other person or persons acting under his direction in removing or trimming any tree, shrub, fence, wall or other structure pursuant to this article shall, upon conviction, be liable to a penalty as provided in §
1-17 of Chapter
1, General Provisions. Each week the violation continues shall be a separate offense.
