[HISTORY: Adopted by the Board of Trustees
of the Village of Muttontown at time of adoption of Code (see Ch.

A.
The establishment, preservation and maintenance of
equestrian bridle paths in newly subdivided or partitioned property
in the Village of Muttontown is in the public interest of the residents
of the Village.
B.
The Village desires to encourage the establishment
and use of these equestrian bridle paths in newly subdivided or partitioned
property in the Village for the exclusive benefit of Village residents
at the least possible public expense and with a minimum adverse effect
on the use, enjoyment and value of property in the Village.
C.
The proper development and use of such equestrian
bridle paths require periodic maintenance and continuing supervision
so as to ensure that the use and existence of these paths will not
be injurious to persons or properties in the Village.
A.
The Board of Trustees and the Planning Board are hereby
authorized to encourage property owners in the Village who intend
to subdivide or partition their property to offer for dedication equestrian
bridle path easements to the Village for use in accordance with this
chapter and subsequent rules and regulations.
B.
The Planning Board is authorized to require any applicant for a partitioning or subdivision to reserve or offer to dedicate to the Village appropriate equestrian bridle path easements as a condition to final Planning Board approval of the application. The land area to be reserved or offered for dedication for such equestrian bridle path easements shall be deducted from the land area required under Chapter 158, Subdivision of Land, to be reserved for park purposes but shall not be included in any computation of lot area for zoning purposes.
C.
The Board of Trustees may accept offers of dedication
of equestrian bridle path easements for newly subdivided or partitioned
land upon the recommendation of the Planning Board.
A.
The Board of Trustees may, by resolution, adopt regulations
to provide for the creation, establishment, safe maintenance, use
and policing of equestrian bridle paths within the easement areas,
upon such terms and conditions as it may deem appropriate; provided,
however, that:
(1)
All equestrian bridle paths established pursuant to
this chapter shall be exclusively available to only residents of the
Village on equal terms;
(2)
Equestrian bridle paths or equestrian bridle path
easement areas shall not be used or traveled upon by any motor vehicles
or equipment, other than those required in establishing and maintaining
the equestrian bridle paths, and except any motor vehicle or equipment
expressly authorized, in writing, by the Village Board of Trustees
or the Police Department; and
(3)
If the Board of Trustees, in its sole discretion,
determines that certain equestrian bridle paths are creating a nuisance
for property owners or are not being used or maintained in accordance
with this chapter and applicable Village, town, county or state rules
and regulations or are having an adverse effect on the use, value
and enjoyment of property in the Village, the Board may, after a public
hearing, unilaterally revoke and terminate the equestrian bridle path
easement, extinguishing all easement rights, interests and obligations
under said easement.
B.
In addition to the regulations referred to in this
section, the Board of Trustees may enter into an agreement with a
recognized nonprofit Village resident organization interested in promoting
horseback riding in the Village for Village residents for the purpose
of providing for the establishment, use, safe maintenance and policing
of equestrian bridle paths.
The Planning Board is hereby authorized to develop
and prepare a plan of existing and proposed equestrian bridle paths
in that area within the Village described as follows: bounded on the
east by the Jericho - East Norwich - Oyster Bay Road and the northeasterly
limits of the Village between said Jericho - East Norwich - Oyster
Bay Road and North Hempstead Turnpike (Route 25A), on the north by
North Hempstead Turnpike (Route 25A) and on the south by Brookville
Road and Muttontown Road.
Violation of the provisions of this chapter
or of any applicable regulation hereunder shall constitute a violation
of the Village Code.
