GENERAL REFERENCES

This chapter is enacted pursuant to § 1660 of the Vehicle and Traffic Law, § 10 of the Municipal Home Rule Law, § 130 of the Town Law, and other legislative authority of New York State, as amended from time to time.
In order to protect and preserve public safety, health and welfare, it is hereby found and declared to be in the best interest of the general public and the citizens of the Town of Woodstock to regulate traffic signage, stopping, standing and parking upon Town streets and roads and upon property owned or leased by or under the jurisdiction of the Town, for the following purposes:
A. 
To reduce driving hazards.
B. 
To expedite the removal of snow.
C. 
To ensure open roads for the movement of emergency vehicles during snowstorms, flood, serious fire, or other extreme public emergency.
D. 
To prohibit overnight parking in municipal parking lots for the purpose of sleeping, camping and/or storing goods or materials.
A. 
The following terms as used in this chapter shall have the meanings indicated:
MUNICIPAL PARKING LOT
Those areas designated in § 233-5A of this chapter owned or leased by, or under the jurisdiction of, the Town of Woodstock for the purpose of providing parking for the general public.
OVERNIGHT PARKING
Any instance where a person occupies a vehicle or vehicles or causes a vehicle or vehicles to be used as storage for goods and/or materials in any area or areas of a municipal parking lot at any time during the hours between sunset and sunrise of the following day.
PARKING
The standing of a vehicle, whether occupied or not, otherwise than temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers.
PEDESTRIAN CROSSING
A place distinctly indicated for pedestrian crossing by lines or other markings on the surface of the street or roadway.
PERSON
Any natural person, individual, firm, partnership, association, corporation, company or organization of any kind.
PROHIBITED PARKING
Parking of a vehicle in:
(1) 
Posted locations where parking is prohibited.
(2) 
Designated handicapped parking locations without proper permit.
(3) 
Such manner that at least one wheel of the vehicle extends unto the roadway in those areas of the Town where there are no posted locations regulating parking.
PROHIBITED PARKING IN CRITICAL NO-PARKING ZONES
Parking of a vehicle in locations where parking is prohibited in a critical no-parking zone.

STANDING
The stopping of a vehicle, whether occupied or not, otherwise than temporarily for the purpose of and while actually engaged in receiving or discharging passengers only.
STOPPING
When prohibited, "stopping" shall mean any halting, even momentarily, of a vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or other duly authorized traffic control personnel or traffic control sign or signal.
TOWN
The Town of Woodstock, Ulster County, New York.
TOWN SUPERVISOR
The Supervisor of the Town of Woodstock or his or her duly authorized agent.
TRUCK
Every vehicle in excess of 79,999 pounds maximum gross weight (as such term is defined in § 122-a of the New York State Vehicle and Traffic Law) designed, used or maintained primarily for the transportation of property.
VEHICLE
Automobile, motorcycle, truck, bus, bicycle, cart, wagon, camper, motor home, recreational vehicle (RV) or any device designed, used or maintained for the transportation of people or goods.
B. 
Definitions of all other terms used in this chapter shall be the same as written in the New York State Vehicle and Traffic Law.

Through truck traffic, except for local deliveries, shall be prohibited on the following road: Van Dale Road from the Town of Hurley - Town of Woodstock boundary line to the intersection of Van Dale Road and Zena Road in the Town of Woodstock.
A. 
The Town of Woodstock Superintendent of Highways and the Town Supervisor, upon resolution of the Town Board, shall prepare, and may from time to time amend, a list of roads within the Town of Woodstock which shall be designated as snow routes, indicating the name of each said road. Such list, and any amendments thereto, shall be filed with the Town Clerk, who, within 10 calendar days of such filing, shall cause such list or amendments thereto to be published once in the official newspaper(s) of the Town. The establishment of such snow routes shall take effect upon such publication, shall continue until modified, and shall be in addition to the snow route established and designated in Subsection B (below).
B. 
The following snow route is hereby established: State Route 212 from its intersection with the western end of Orchard Lane to its intersection with State Route 375.
A. 
Declaration of emergency. The Town Supervisor may declare a state of snow emergency or other emergency in cases of flood, serious fire, or other extreme public emergency whenever, in the Supervisor's judgment, conditions resulting therefrom create dangerous driving conditions within the Town.
B. 
Notice of snow emergency. Upon declaration of a snow emergency, the Town of Woodstock Superintendent of Highways shall erect and maintain appropriate signs at reasonable intervals along established snow routes to provide notice that it is unlawful to park or abandon any vehicle along or upon an established snow route during such declared snow emergency.
C. 
Effect of declared emergency. During the existence of any declared emergency, it shall be unlawful to park or abandon any vehicle along or upon any established snow route or upon that portion of the public roads or highways affected by the conditions resulting from flood, serious fire, or other extreme public emergency.
The Town of Woodstock may provide for the removal and storage of any vehicle or vehicles parked or abandoned on streets, roads and highways during snowstorms, floods, fires or other public emergencies; or found unattended where they constitute an obstruction to traffic or in any place where stopping, standing or parking is prohibited; or in violation of any provision(s) of this chapter. In the event of such removal and storage, the Town shall provide for the payment of reasonable charges by the owner of any such vehicle(s).

A. 
A violation of the provisions of §§ 233-4 and 233-5B of this chapter, which regulate parking and standing along and upon streets and roads and in municipal parking lots, shall constitute an offense punishable by a fine of $25 if paid within 72 hours of receipt of a parking ticket therefor or $40 if paid thereafter.
B. 
A violation of the provisions of § 233-5C of this chapter, which regulates overnight parking in municipal parking lots, shall constitute grounds for removal and storage, pursuant to § 233-13 of this chapter, of any vehicle so parked and/or shall be subject to the following fines for violations within a calendar year:
(1) 
First offense: fine of $50.
(2) 
Second offense: fine of $100.
(3) 
Third offense: fine of $200.
(4) 
Each additional offense: fine of $300.
C. 
Any person convicted of a violation of the provisions of § 233-12C of this chapter, pertaining to declared emergencies, shall be fined not less than $50 nor more than $1,000 for each offense. Each day that a violation continues shall be considered a separate offense.
D. 
Cars parked in designated critical no-parking zones may be towed away at the owner's expense and redeemed for an amount no less than $300 and no more than $500. Any person convicted of a violation of the provisions of § 233-4B of this chapter, pertaining to critical no parking zones, shall be fined up to $150 for each offense. Each day that a violation continues shall be considered a separate offense.

This chapter shall supersede Section II of the Woodstock Ordinances of 1934, titled "Ordinance Regulating the Parking of Vehicles," and Local Law No. 4 of the year 2002, as amended by Local Law No. 2 of the year 2003 and Local Law No. 1 of the year 2004, constituting the traffic and parking laws and regulations of the Town of Woodstock as heretofore in force, which are hereby repealed.
This chapter shall be known and may be cited as the "Traffic Signage and Parking Law of the Town of Woodstock."
