By the adoption of this article, the Town Board
of the Town of North Greenbush declares its intent to be to regulate,
in a manner consistent with the interests of the citizens of the Town
of North Greenbush, the dumping of offal, garbage, trash, refuse,
rubbish, debris and like waste materials on lands within the Town.
Garbage is a deleterious substance. Unattended,
private and public garbage dumps and disposal areas emit noxious odors
and fumes, attract rodents and vermin and become breeding places therefor.
All these conditions can adversely affect the developing of the Town
unless they are properly and carefully regulated. Therefore, recognizing
the above and the needs of our Town and in the exercise of its police
power in these regards, the Town Board of the Town of North Greenbush
does hereby enact this article.
This article shall not prohibit the establishment
by resolution of the Town Board of public dumps or dumping grounds
from time to time as the necessity therefor shall arise, and the regulation
and use of such public dumps or dumping grounds shall be set forth
and established by resolution of the Town Board.

Any person violating the provisions of this
article shall be guilty of a misdemeanor and shall be subject to a
fine not exceeding $1,000 for each offense or imprisonment for not
more than 15 days. In addition, such violator may be required to remove
all offal, garbage, trash, refuse, rubbish, debris and other waste
materials dumped in violation of this article as a condition of sentence.
