This chapter shall be known as the "North Greenbush Town Junk
Vehicle Law."
It is hereby declared that visible junk vehicles stored or located
within the Town are unsightly and potentially dangerous. It is the
purpose of this chapter to forbid the storage of visible junk vehicles
within Town limits.
For the purpose of this chapter, the following words, terms
and phrases are defined as:
JUNK VEHICLE
Any motor vehicle, including automobiles, buses, trucks,
tractors, mobile homes, motorcycles, motor bicycles, snowmobiles,
boats, recreational vehicles, watercrafts, camping trailers, or any
other contraptions originally intended for travel on streets, highways,
or waterways, whether intact or dismantled, which:
A.
Vehicle is not currently registered by the State of New York
or any other state or foreign country and which has not been so registered
for the preceding six months; or
B.
Vehicle is not currently registered by the State of New York
or any other state or foreign country and which is not in a condition
to meet New York State motor vehicle inspection requirements.
PERSON
Includes any individual, firm, partnership, association,
corporation, company or organization.
It shall be an affirmative defense to any violation of this
chapter if:
A. The vehicle in question is used for legitimate farm purposes.
B. The vehicle in question is operable and used by the owner on his
own property for the transport of wood, snowplowing or for other legitimate
purposes.
C. The vehicle constitutes an antique vehicle.
D. The junk vehicle is stored, left or located on premises which are
used for the legal operation of a junkyard as a junkyard is defined
in the State General Municipal Law.
Any person who shall violate any provisions of this chapter
shall be guilty of an offense and subject to a fine of not more than
$250 per junk vehicle involved. Every such person shall be deemed
guilty of a separate offense for each week that such violation continues.
