This article is enacted pursuant to the authority of Municipal Home Rule Law § 10, Subdivision 1(ii)a(1), authorizing towns to adopt a local law which may amend or supersede any provision of the Town Law in relation to the qualifications of its officers and employees.

Section 23 of the Town Law is hereby amended and superseded in its application to the Town of Owasco to provide that the Town Attorney of the Town of Owasco at the time of appointment and throughout his or her term of office need not be an elector of the Town of Owasco so long as he or she is a resident of the County of Cayuga of the State of New York or has an office for the practice of law in the County of Cayuga of the State of New York. A new sentence is hereby inserted at the end of § 23 of the Town Law to read and provide as follows: "The Town Attorney of the Town of Owasco at the time of appointment and throughout his or her term of office need not be an elector of the Town of Owasco so long as he or she is a resident of the County of Cayuga of the State of New York or has an office for the practice of law in the County of Cayuga of the State of New York."
