The purpose of this article is to regulate the use of the Recycling Center of the Town of Owasco.
The following terms shall have the meanings indicated in this section:
PERSON
Any individual, firm, partnership, corporation or association of persons; the singular number shall include the plural.
RECYCLING CENTER
The grounds, buildings and any other property necessary for the operation thereof, and constituting a part thereof, which is now or may hereafter be maintained, operated and controlled by the Town of Owasco for the collection of garbage, trash, refuse, recyclable items, brush, grass, and leaves.
TOWN
The Town of Owasco.

A. 
The following activities are prohibited:
(1) 
Entering or using the Recycling Center at times other than the hours set forth in § 119-4 of this article for disposal of garbage, trash, or refuse. However, the disposal of brush, grass, leaves, and metal in their properly designated areas is permitted at any time.
(2) 
Disposal of any garbage, trash, or refuse without the use of Town of Owasco authorized tags/stickers.
(3) 
Disposal of any household appliance containing freon gas.
(4) 
Disposal of any building materials.
(5) 
Disposal of tires.
B. 
Miscellaneous.
(1) 
Use of the Recycling Center is limited to Owasco Town residents and Owasco property owners only, with the following exception:
(a) 
The Director of Public Works and/or Refuse and Garbage Manager, in his sole discretion, upon presentation of satisfactory proof, may grant permission to a contractor hired by an Owasco Town resident or Owasco property owner to use the Recycling Center for a specific purpose and limited period of time, subject to the laws, regulations and rules of the Town of Owasco. A fee to a contractor hired by an Owasco Town resident or Owasco property owner may be established and adjusted by resolution of the Town Board.
(2) 
Owasco Town residents and property owners may purchase Town of Owasco authorized tags/stickers at the Recycling Center or the Owasco Town Hall during normal business hours.
(3) 
Bulk items, such as furniture and household appliances not containing freon, may be disposed of after making prior arrangements with a Recycling Center employee and paying the associated disposal fee. A fee schedule is available at the Recycling Center or the Owasco Town Hall. Said fees may be established and adjusted by resolution of the Town Board.
(4) 
The Town is not responsible for any injuries resulting from the use of the Recycling Center.
The Recycling Center is open on Saturdays from 7:00 a.m. to 1:00 p.m. and Wednesdays from 4:00 p.m. to 7:00 p.m. The Town may change the hours of operation at any time by posting the change and effective date of such change at the Town Hall and the Recycling Center.
A. 
A violation of this article shall constitute an offense punishable by a fine not to exceed $50 for each and every such offense, in addition to any landfill disposal costs and labor costs incurred by the Town to properly dispose of any items not properly disposed of.
B. 
Any state police officer or police officer of Cayuga County or any of its municipal subdivisions may, without a warrant, arrest any offender whom he or she may detect in the violation of any of the provisions of the above sections, and take the persons so arrested forthwith before a magistrate having competent jurisdiction, and he shall have at all times a right to enter the premises of any building, structure or enclosure in the Recycling Center, including such grounds, buildings, structures or enclosures in any Town recycling center for the purpose of arresting violators hereof, and may use all necessary means to attain that end.
