The purpose of this chapter is to provide authority for the fingerprinting
and criminal record checks for prospective Village employees in the Village
of Port Chester. As a part of an overall background investigation, such process
will assist the Village in evaluating the background of applicants, protect
the Village from potential liability for negligent hiring and/or retention
and ensure the confidence of the public by employing only qualified and capable
individuals.

Whenever used in this chapter, the following terms shall mean:
APPLICANT
An applicant for employment, whether full-time or part-time, with
the Village of Port Chester, including marshals, except for police officers.
DCJS
The New York State Division of Criminal Justice Services.
VILLAGE
The Village of Port Chester.

An applicant shall submit to be fingerprinted by the Police Department
as a condition to his/her possible employment with the Village. The Village
Manager or his or her designee shall forward said fingerprints
to DCJS for identification processing. Upon receipt and review
of the criminal history information from DCJS, the Village Manager may
disqualify said applicant for employment if the applicant has been convicted
of a felony or misdemeanor under the laws of the State of New York or a crime
committed in violation of the laws of any other jurisdiction which if committed
in New York would be a felony or misdemeanor, unless any such conviction has
been removed as provided for under Article 23 of the Corrections Law. The
cost of fingerprinting and all processing fees shall
be borne by the applicant.
