This chapter shall be known as "Chapter 319, Vehicles and Traffic, of the Code of the Village of Port Chester" and shall apply within the Village of Port Chester to all drivers and/or owners of motor vehicles using the highways of the Village.[1]
Editor's Note: Sections II and III of this local law read as follows: "Section II. Continuation of existing regulations. The provisions of § 319-59 notwithstanding, nothing in this local law shall be construed to repeal any ordinance, local law, resolution or regulation in effect prior to the effective date of this local law which would establish a regulation which would be listed in any of the schedules established by § 319-4, and such ordinances, local laws, resolutions or regulations shall remain in full force and effect until such time as the Board of Trustees shall amend, revise or repeal such ordinances, local laws, resolutions or regulations by the adoption of new schedules in the manner prescribed in § 319-4. Section III. Confirmation of existing regulations. Any ordinances, local laws, resolutions or regulations relating to the regulation of vehicles and traffic heretofore adopted and saved from repeal in Section II are hereby confirmed to be in full force and effect, regardless of the procedure, numbering system or form under which such regulations were adopted."
The words and phrases used in this chapter shall,
for the purposes of this chapter, have the meanings respectively ascribed
to them by Article 1 of the Vehicle and Traffic Law of the State of
New York.
The following words and phrases, which are not defined
by Article 1 of the Vehicle and Traffic Law of the State of New York,
shall have the meanings respectively ascribed to them in this section
for the purposes of this chapter:
New Year's Day, Birthday of Martin Luther King, Jr., Washington's
Birthday (President's Day), Memorial Day, Independence Day, Labor
Day, Columbuy Day, Veterans Day, Thanksgiving Day and Christmas Day.
A designated location upon or within which the parking of
vehicles is regulated by parking meters. For purposes of this chapter,
a "parking meter zone" shall be a "limited time parking area."
A plot or parcel of land or building owned and/or leased
by this Village, not including highways, upon or within which the
parking of vehicles is regulated by signs and/or parking meters.
Tires mounted on drive wheels of motor vehicles which are
especially designed to give effective traction on snow-, mud- or ice-covered
streets by means of extra heavy-duty treads with special high-traction
patterns, except that no tire so defined shall be construed to be
a snow tire if it is damaged or worn to the extent that its performance
would be substantially impaired or if the depth of the treads thereof
do not comply with the standards for usable tires as required by the
statutes in such case made and provided.
The Chief of Police shall provide for the installation
and maintenance of traffic control devices, when and as required under
the provisions of this chapter, to make effective the provisions of
this chapter and may install and maintain such additional traffic
control devices as the Board of Trustees may deem necessary to regulate,
warn or guide traffic under the Vehicle and Traffic Law of the State
of New York, subject to the provisions of § 1682 and 1684
of that law.
Except where obedience to the provisions of this chapter
is required by the Vehicle and Traffic Law of the State of New York,
every person is hereby required to obey all applicable provisions
of this chapter and of every regulation adopted pursuant thereto,
provided that, where applicable, notice of such provisions or regulations
is properly posted as required by law. The Chief of Police is hereby
charged with enforcement of these regulations and is, in addition,
empowered to make and enforce temporary regulations for emergency
or special conditions.
For the purpose of maintaining an accurate record of all regulations adopted under the provisions of this chapter, there is hereby established a system of schedules, appearing as Article XII of this chapter, in which shall be entered all regulations after adoption. Such schedules shall be deemed a part of the section to which they refer. All regulations shall be adopted with reference to the appropriate schedule as indicated in the various sections of this chapter.
Regulations shall be adopted by resolution of the
Board of Trustees in accordance with the provisions of the Village
Law and the Vehicle and Traffic Law, or by an officer or agency authorized
by the Board of Trustees to adopt regulations pursuant to § 1603
of the Vehicle and Traffic Law.
