A. 
The Village of Port Chester shall offer for sale, to residents and nonresidents, decals for the convenience of parking in certain municipal parking lots and Village streets.
B. 
Any resident of the Village of Port Chester or any nonresident who is employed by a business within the Village of Port Chester shall have the right to apply to the Village and shall, upon payment of the annual fee as noted in § 175-4, entitled "Enumeration of fees," of the Code of the Village of Port Chester, and subject to availability, be entitled to receive a decal entitling him/her to park his/her automobile in the places and locations described in Schedule XXVIII (§ 319-89). Such decal shall be affixed to the left rear, clean bumper of said automobile. Applicants who request two plate numbers on the decal shall place the decal on the rear window, left side. All such vehicles in a parking lot are to be parked front wheels in. Decals shall not be transferable.
C. 
Decal parking shall be limited to 9:00 a.m. to 6:00 p.m. unless specified otherwise in Schedule XXVII (§ 319-89).
D. 
Decals, when issued, shall be valid for one-year periods, from January 1 to December 31 or for six-month periods from January 1 to June 30 and from July 1 to December 31.
E. 
For purposes of this Article VIII, the term "automobile" shall be limited to passenger vehicles and other vehicles that do not:
(1) 
Weigh in excess of 5,000 pounds unloaded;
(2) 
Display commercial license plates; or
(3) 
Display signs, plates or other paraphernalia indicating they are commercial vehicles.

A. 
Establishment of parking permit system. A residential parking permit system is hereby established for the Washington Park Area, subject to the provisions of this section and in accordance with § 1640-s of the New York State Vehicle and Traffic Law.
B. 
Permit area. The "permit area" shall consist of the area described in § 1640-s (2) of the New York State Vehicle and Traffic Law, as the same may be amended from time to time.
C. 
Effective date of program. The Residential Parking Permit Program established herein shall become effective on June 1, 2026.
D. 
Exempt vehicles. Motor vehicles registered pursuant to § 404-a of the New York State Vehicle and Traffic Law (special plates for persons with disabilities) shall be exempt from the residential parking permit requirements of this section.
E. 
Number of permits; nonresident availability. The total number of residential parking permit decals to be issued shall be determined by resolution of the Board of Trustees. No less than 15% of all parking permits within the permit area shall be made available to non-residents. Such non-resident permits shall be issued only at the request of a resident of the permit area as detailed in Subsection K(5) below.
F. 
Permit parking hours. Permit parking restrictions shall apply seven days per week, including holidays, between the hours of 1:00 a.m. and 8:00 a.m.
G. 
Permit limits per household. Each household within the permit area may obtain up to four parking permit decals on a first-come, first-served basis.
H. 
Permit fees and terms.
(1) 
The first two permits issued to a household shall be free of charge and valid for a period of one year, from January 1 through December 31.
(2) 
The third and fourth permits ("visitor permits"), and any replacement decals shall each require a fee as set forth in Chapter 175 "Fees" and shall be valid for six months, beginning January 1 and July 1 of each year. Fee amounts shall not be prorated regardless of the date of issuance.
(3) 
Any change to a permit during its term (including vehicle substitution) shall incur an administrative fee as set forth in Chapter 175 "Fees." Such change shall not alter the original expiration date of the permit.
(4) 
All permit fees collected under this section shall be credited to the general fund of the Village of Port Chester.
I. 
Amendment of fees. The Board of Trustees may, by resolution, increase or decrease any permit fee or administrative fee set forth in this section.
J. 
Placement of permit sticker. The parking permit decal shall be affixed to the driver-side rear passenger window of the permitted vehicle in a manner clearly visible from the exterior.
K. 
Eligibility and application requirements.
(1) 
Outstanding parking citations.
(a) 
All outstanding parking citations must be paid in full prior to issuance of a residential parking permit.
(b) 
No parking permits shall be issued to any individual with unpaid or unresolved parking citations.
(2) 
Vehicle registration.
(a) 
Vehicles must have valid registration that is not expired, suspended, or revoked.
(3) 
Application for vehicles registered at the permit address. Applicants must:
(a) 
Complete an application form online on the Village website or in-person at the Village Clerk's office;
(b) 
Attach a photocopy of the vehicle registration showing the applicant's name and address within the permit area;
(c) 
Provide a driver's license and two current proofs of address, which may include: residential lease, property tax bill, or entire utility bill (cable, electric, gas, oil, propane, or water) dated within 30 days prior to application;
(d) 
Pay fee for each visitor permit requested by cash, money order, or online by credit card;
(4) 
Application for vehicles not registered at permit address.
(a) 
Applicants with vehicles registered in New York or out of state but not at the permit address must provide documentation as set forth in Subsection K(3)(c), above.
(5) 
Non-resident permits. Permit applicants who do not reside in the permit area shall follow all of the same procedures in this Subsection K and shall additionally provide a completed non-resident form (available on the Village website), signed by a resident of the permit area and notarized, along with copies of said resident's documents required in Subsection K, above.
L. 
Enforcement and penalties.
(1) 
It shall be a violation of this section to park any motor vehicle within the permit area during the applicable permit hours without displaying a valid residential parking permit.
(2) 
Any such violation shall constitute a parking infraction, subject to a fine as established in § 319-91 Schedule XXX: Fines, "No Permit."
