This chapter shall apply to the delivery of distillate fuels and the
filling of all storage tanks with holding capacities of 500 gallons or more.
For the purposes of this chapter, the following terms shall have the
meaning indicated:
A. The delivery truck must not be left unattended by the
truck operator once the filling nozzle has been set in place for filling.
B. While filling is taking place, the delivery truck operator
must remain within 10 feet of the truck turnoff controls until filling is
complete and the nozzle removed.
C. All filling nozzles must be protected from accidental
dislodgment by the use of a manhole guardrail.
D. The type and nature of the manhole guardrail shall be
approved by the Director of Public Works.
E. In those cases where the truck operator cannot see the
fill nozzle and still remain within 10 feet of the turnoff controls, a representative
of the owner or lessee of the holding tank shall stand watch over the fill
nozzle so as to be able to advise the truck operator of any occurrence.
A. Violation shall be punishable as provided for in Article
I of Chapter
1 of the City Code.
B. In addition to the penalty set forth above, any violator
shall be responsible for any and all costs incurred by the City of Port Jervis
resulting from violation of this chapter.
C. This chapter may be enforced by any police officer, member
of the City Fire Department, the Director and all employees of the Public
Works Department, the Fire Inspector and the Building Official.
