Editor’s Note: This local law also repealed former Ch. 445, Sewers and Sewage Disposal, adopted 7-8-1968 (Ch. 23 of the 1964 Code of Ordinances; Ch. 129 of the 1981 Code), as amended, except for L.L. No. 12-2014, which remains in force and effect upon adoption of this chapter; see § 445-142B. Said L.L. No. 12-2014, added 10-14-2014, as amended 12-8-2014 by L.L. No. 13-2014 and 9-26-2022 by L.L. No. 8-2022, stated as follows: A. All users of the sewer system of
the City of Port Jervis shall be required to pay a sewer use fee.
The sewer use fee shall be set at a rate to be determined by resolution
of the Common Council from time to time. B. Reductions to the sewer
use fee shall be established for residents of the City of Port Jervis
who were granted and/or approved for the partial tax exemption for
real property of senior citizens under NYS Real Property Tax Law Section
467; the reduction of the sewer use fee will terminate on the date
the property owned by the NYS Real Property Tax Law Section 467 exemption
recipient is sold/conveyed to an individual(s) who does not qualify
for said exemption. C. All billings pertaining to sewer fees shall
follow the same procedure as current water rents. Unpaid, delinquent
sewer fees will be relevied in the City tax bills and shall be a lien
on the properties serviced.
