[Adopted 2-8-1965 (Ch. 138, Art. III of the 1981 Code)]
It shall be unlawful for any person, firm or corporation to construct or alter any building or structure, other than fences, in the City except upon compliance with the provisions of this article.
Permission for the use of streets or sidewalks for the storage of materials in the process of construction or alteration of a building or the alteration or improvement of vacant premises may be granted when the same will not unduly interfere with traffic and will not reduce the usable width of the street or sidewalk to less than 2/3 thereof; no portion of a street or sidewalk other than that directly abutting on the premises on which work is being done shall be used except with the consent of the owner or occupant of the premises abutting on such portion. Any person seeking to make such use of the street or sidewalk shall file an application with the Clerk-Treasurer, together with a bond with sureties to be approved by and in such amount as the Clerk-Treasurer may determine, to indemnify the City for any loss or damage which may be incurred by reason of such use and occupation.

No construction or alteration operations shall be carried on at nighttime if the same are accompanied by loud or annoying noises.
No sidewalk shall be obstructed in the course of building operations without a special permit from the Clerk-Treasurer, and whenever a removal of a sidewalk is required, such work shall not be done until a special permit is secured from the Clerk-Treasurer.
It shall be the duty of a person or corporation doing any constructing, altering or wrecking to do the same with proper care for the safety of persons and property.
Warning barricades and red lanterns shall be maintained whenever necessary for the protection of pedestrians or traffic; and temporary roofs over sidewalks shall be constructed whenever there is danger from falling articles or materials to pedestrians.

Any damage resulting from the obstruction, encumbrance or occupation of a public street, highway or sidewalk area or from the storage of materials or operation of construction equipment or machinery shall be repaired by the permittee to the satisfaction of the Director of Public Works when so ordered.
The permittee shall keep clear and unobstructed at all times and shall in no way interfere with prompt access to or adequate operation of all manholes, catch basins, hydrants, valves or fire alarm boxes that may be situated in or near the area obstructed or occupied in accordance with the permit.

Any person committing an offense against any provision of this article shall be punishable as provided in Chapter 1, General Provisions, Article I.
