In the opinion of the Board of Trustees, the best interests of the Village will be promoted by permitting a member of the Board of Trustees to also hold the paid, appointed position of Superintendent of Public Works of the Village. To this end, it is the intention of the Board of Trustees to supersede the provisions of § 3-300(3) of the Village Law to the extent that it would prohibit a member of the Board of Trustees from serving as Superintendent of Public Works.
Pursuant to the provisions of Article IX of the New York State Constitution and Subdivision 1(ii) of § 10 of the Municipal Home Rule Law, Subdivision 3 of § 3-300 of the Village Law is hereby superseded in its application to the Village of Port Washington North to the extent that a member of the Board of Trustees of the Village of Port Washington North may simultaneously hold the paid, appointed position of Superintendent of Public Works of the Village of Port Washington North.
