[HISTORY: Adopted by the Board of Trustees of the Village of Pulaski 9-10-1987 by L.L. No. 2-1987. Amendments noted where applicable.]
This chapter is enacted for the purpose of regulating fish cleaning and disposal in the Village of Pulaski in order to protect the property, safety, health, comfort and general welfare of the inhabitants of the Village of Pulaski.
A. 
It shall be unlawful within the Village of Pulaski to clean fish or to dispose of or bury fish carcasses and remains within 100 feet of the shore of the Salmon River or within 100 feet of the center line of any public street or highway within the Village.
B. 
It shall be unlawful to clean fish or to dispose of or bury fish carcasses or remains on all Village public lands.
C. 
Commercial fish cleaning stations, holding a valid, current permit, issued pursuant to § 60-4C, may lawfully clean fish and dispose of fish carcasses and remains within 100 feet of the Salmon River or within 100 feet of the center line of any public street or highway within the Village and upon the Village public lands, as designated and authorized by the Village Board of Trustees, upon recommendation of the Fish Cleaning and Disposal Control Inspector.

The position of Fish Cleaning and Disposal Control Inspector is hereby established to help administer the provisions of this chapter and regulations adopted pursuant thereto.
A. 
In areas outside the prohibited areas and where lawfully allowed, commercial fish cleaning stations may be set up, so that fish carcasses and remains will be disposed of in a sanitary manner.
B. 
Where permissible commercial fish cleaning stations shall be operated so long as said stations meet the following requirements:
(1) 
The structure of each commercial fish cleaning station shall be totally enclosed with sufficient ventilation in order to avoid obnoxious odors spreading to nearby properties. In the event that such ventilation is not totally sufficient to avoid obnoxious odors from traveling to nearby properties, then the operator shall be required to take whatever steps necessary to reduce said odors. Failure to do so may result in a fine and/or revocation of the permit.

(2) 
The tables and cleaning equipment shall be of metal, galvanized or stainless steel, with splash boards six inches high, except for cutting areas. All drains must be screened to catch particulate. Any new facility should be professionally designed and approved by the County Health Department.

(3) 
All entrails shall be kept in sealed, non-leaking containers and shall be removed at least on a daily basis, or if not removed on a daily basis all entrails must be kept refrigerated until such time as they are removed, and when traveling from the commercial fish cleaning station to disposal they shall be kept in sealed non-leaking containers.
(4) 
All commercial fish cleaning stations shall use fresh water and must be tied in to the Village sanitary sewer system, when the sanitary sewer system is available. In instances where the Village sanitary system is not available, the operator must ensure that the liquids are separated from the entrails and other solid matters and that the liquids go into a holding tank and entrails handled as set forth in Subsection B(3) above.

(5) 
Said commercial fish cleaning station shall have sufficient and appropriate off-street parking.
(6) 
There will be a cleaning of the area and equipment on a continuous basis and sanitizing daily at the end of operating hours.
(7) 
There will be an evaluation and inspection of the facilities at any reasonable time during operational hours by the Fish Cleaning and Disposal Control Inspector to determine compliance with this chapter. There shall be an annual review of all permits for assessment of operations. Upon inspection, the Fish Cleaning and Disposal Control Inspector shall prepare an inspection report to be given to the owner at the time of said inspection, which shall include a time table for compliance.

C. 
A permit from the Fish Cleaning and Disposal Control Inspector for a commercial fish cleaning station shall be required and the cost thereof, per year, shall be as established by the Village Board, with said year running from September 1 through August 31 of the following year.

D. 
The Village Board of Trustees may adopt additional specific regulations after a public hearing as to minimum standards for fish cleaning stations.

For the purpose of this chapter, fish cleaning stations shall be considered commercial when:
A. 
Users of the station either pay for use of the facilities to clean their own fish or for others to clean the fish which they have caught; or
B. 
Use of the station as an accommodation to patrons of any other commercial operation, for example, when a motel or lodge offers the use of its station to tenants or lodgers of such facility.

The violation of this chapter shall be punishable by a fine of $1,000, imprisonment for not more than one year, or both. Fines shall be assessed on a day-to-day basis. Revocation of commercial permits shall be discretionary for the first and second violation, but upon a third violation, revocation shall be mandatory.
