As used in this chapter, the following terms shall have the meanings
indicated:
Any body of water or receptacle for water having a depth greater
than 24 inches or a surface area greater than 250 square feet, used for swimming
or bathing and constructed, installed or maintained in or above the ground.[1]
A swimming pool may be maintained as an accessory use in any zoning
district subject to the following regulations:
A.
Pool permit; fee. No swimming pool shall be constructed
or erected until a pool permit is granted. A fee as established by the Village
Board shall be charged for any permit so granted. Application for a permit
shall be accompanied by a plan showing the approximate location and construction
of the pool, filtering system, power supply, existing buildings, water, sewer,
power and gas lines and the method of disposal of waste water.[1]
B.
Yards. A swimming pool shall not be located nearer to
the street than the established setback line, and the pool and the appurtenances
thereto shall be located so as to have a yard not less than 10 feet in width
on all sides.[2]
C.
Fences. Swimming pools shall be surrounded by a fence
or barrier at least four feet in height for an aboveground pool; four feet
in height for an in-ground pool, but not over six feet in height, strong enough
to make the pool inaccessible to small children and shall have a gate equipped
with self-latching devices. This fence may be located on a property line and
shall have no openings (other than doors or gates) larger than three inches
square.[3]
D.
Lighting. Pool lighting shall not shine or reflect onto
adjoining property.
E.
Overhead power lines. No overhead power lines shall pass
over the pool nor shall be maintained within 20 feet of the pool.
F.
Maintenance equipment. All heating, filtering, disinfectant
and recirculating equipment shall be located at least five feet away from
the property lines.
G.
Code compliance. All new installation of pools shall
conform to the National Underwriters Code, which shall include a ground fault
circuit.
I.
Abandonment. Abandoned pools shall be removed and the
land returned to its original grade; aboveground pools shall be removed entirely
from the premises.
J.
Modification. The Board of Appeals may approve modifications
upon written request of applicant, to these requirements in individual cases,
with respect to the nature or location of pools, fences, gates or locking
devices, provided the protection as sought hereunder is not reduced.
