[HISTORY: Adopted by the Town Board of the Town of Tonawanda 7-15-1974 as Chapter 6 of the 1974 Code of the Town of Tonawanda. Amendments noted where applicable.]

It shall be lawful for any authorized organization, as defined in § 476 of the General Municipal Law, upon obtaining the required license, to conduct the game of bingo within the territorial limits of the Town of Tonawanda subject to the provisions of this chapter, Article 14-H of the General Municipal Law, Article 19-B of the Executive Law, the rules and regulations promulgated by the Lottery Control Commission[2] and the restrictions herein set forth.

No person, firm, association, corporation or organization, other than a licensee under the provisions of Article 14-H of the General Municipal Law, shall conduct such game or shall lease or otherwise make available for conducting bingo a hall or other premises for any consideration whatsoever, direct or indirect.
No authorized organization licensed under the provisions of Article 14-H of the General Municipal Law shall purchase or receive any supplies or equipment specifically designed or adapted for use in the conduct of bingo games from other than a supplier licensed under the Bingo Control Law or through another organized organization.
No bingo game shall be held, operated or conducted on or within any leased premises if rental under such lease is to be paid wholly or partly on the basis of a percentage of the receipts or net profit derived from the operation of such game.
The entire net proceeds of any game of bingo and of any rental shall be exclusively devoted to the lawful purposes of the organization permitted to conduct the same.

No prize in any single game of bingo shall exceed the amount specified in § 479 of the General Municipal Law of the State of New York, as amended from time to time.

No series of prizes on any one bingo occasion shall aggregate more than the limit specified in § 479 of the General Municipal Law of the State of New York, as amended from time to time.
A. 
No person except a bona fide member of any such organization shall participate in the management or operation of any such game.
B. 
No person shall receive any remuneration for participating in the management or operation of any such game of bingo.

The game of bingo may be conducted on Sunday. Whenever a license authorizes the conduct of bingo on Sunday, it shall so state.
No person under the age of 18 years shall be permitted to participate in any game or games of chance operated and conducted pursuant to any license issued under this chapter unless accompanied by an adult.
No alcoholic beverages shall be sold in any room or outdoor area during the progress of any game or games of chance except in a separate building or structure which shall be situated at least 100 feet distant from the room, building, area or structure where such bingo, game or games of chance are being conducted or played.

No game or games of chance shall be conducted, played or operated on more than 10 separate occasions in the Town of Tonawanda on any single day.
The unauthorized conduct of a bingo game and any willful violation of any provision of this chapter shall constitute and be punishable as a misdemeanor.
