This article is intended to promote and improve
the health, safety and general welfare of the community by regulation
of the parking areas and driveways of Kenmore Mercy Hospital, Town
of Tonawanda, New York. This article is enacted pursuant to a written
request by the chief administrator of the hospital and is authorized
by § 1660-a of the Vehicle and Traffic Law of the State
of New York.
This article shall only apply to the parking
areas and driveways of Kenmore Mercy Hospital, 2950 Elmwood Avenue,
Town of Tonawanda, New York.
It will be the responsibility of Kenmore Mercy
Hospital to place and maintain traffic signs and pavement markings
in compliance with the provisions of this article. Traffic signs and
pavement markings shall conform to the provisions of this article
indicating the special regulations applicable to each location and
shall be installed in accordance with the New York State Traffic Commission's
Manual of Uniform Traffic Control Devices.
The maximum speed at which vehicles may proceed
on or along any of the driveways or in any of the parking areas of
Kenmore Mercy Hospital property shall be 20 miles per hour.
This article shall be enforced by the Town of
Tonawanda Police Department, in the manner provided by law, rule or
regulation for the enforcement of traffic or parking ordinances, laws
or rules in the town, including the use of tags, summonses and towing.
Any vehicle towed under the authority of this section will not be
released to its owner until the owner has paid the reasonable cost
of towing and storing the vehicle.
The Chief of Police shall have the power to
promulgate rules and regulations designed to effectuate the goals
of this article.
A violation of this article shall constitute
a traffic infraction within the meaning of § 1800 of the
Vehicle and Traffic Law of the State of New York.
Every person convicted of a traffic infraction
for a violation of this article shall be punished by a fine of not
more than $50; and for a second or subsequent conviction within 18
months thereafter by a fine of not more than $100 for each violation.
