This article is intended to ensure that the Town of Tonawanda may best discharge its duty to maintain and keep in good repair and free from snow and ice certain parking fields and driveways as hereinafter described, situated in the town, exclusive of the Village of Kenmore. This article is further intended to ensure that the above-mentioned parking fields and lots may be operated in the manner that will best serve the facilities they adjoin.
A. 
Notwithstanding any other provisions of the ordinances or local laws of the Town of Tonawanda, County of Erie, State of New York, no person, firm or corporation shall stand or park, or cause to stand or park, any vehicle owned or under the control of said person, firm or corporation in any driveway or parking field accessory to any facility or structure where either the facility or structure or the accessory driveways or parking fields are owned or operated by the town except when:
(1) 
The person causing the vehicle to stand or park is using the facility for a purpose for which the facility is maintained; and
(2) 
The facility is open for such purpose.
B. 
Within any of the driveways or parking fields described in Subsection A above, no person, firm or corporation shall stand or park, or cause to stand or park, any vehicle in violation of any other restrictions, rules or regulations pertaining to such driveway or parking field which have been established by any official or body having regulatory or management duties regarding such driveway or parking field. Any official or body described herein may establish such other restrictions, rules or regulations as may be necessary for the safety of persons attending the facility or the maintenance of the facility, its parking fields and driveways or as may otherwise be necessary to achieve the purposes of the facility.
Violation of this article or any part thereof is hereby declared to be an offense as provided by § 135 of the Town Law of the State of New York, punishable by a fine not to exceed $50 or imprisonment not to exceed 90 days, or both; provided, however, that for the purpose of conferring jurisdiction upon courts and judicial officers generally, such violations shall be deemed misdemeanors, and for such purpose only, all provisions of law relating to misdemeanors shall apply to such violations.
