The regulations, restrictions and boundaries herein provided may be from time to time amended, supplemented, changed, modified or repealed by the Town Board upon its own motion or upon petition, after a public hearing in relation thereto at which parties in interest and citizens shall have an opportunity to be heard. At least 10 days' and not more than 20 days' notice of the time and place of such hearing shall be published in a paper of general circulation in the Town of Tonawanda.
If any area is transferred from one district to another district of more restricted used any nonconforming use then existing within said area may be continued.
Whenever the owners of 50% or more in frontage of any real estate or lands in any district or a specified part thereof shall present their signed petition to the Town Board requesting any amendment, supplement, alteration or change in or the repeal of the regulations and restrictions prescribed for such real estate or districts or specified part thereof, it shall be the duty of the Board to call a public hearing thereon, notice of which hearing shall be given in the same manner as provided in § 215-129 of this chapter. After such public notice and hearing upon such petition, the Town Board shall decide by a majority vote upon the request within 45 days after its filing with the Clerk; provided, however, that if a petition in writing against such proposed amendment or repeal, signed by owners of 20% or more of the district or specified part thereof, is filed with the Town Clerk before action by the Board upon such petition, said amendment or repeal shall require a four-fifths vote of the Town Board to effect its adoption. The Town Board may grant or deny the request in whole or in part.
Upon presentation to the Town Board of a petition to amend, supplement, alter, change or repeal this chapter, the petitioner shall pay to the Town Clerk the sum of $100 to defray the expense of publication, posting or notices and any other necessary expenses of the Town in connection therewith.

Properties within unzoned areas/districts of the Town of Tonawanda (banks, schools, cemeteries, churches, etc.) shall be appropriately zoned by the Town Board of the Town of Tonawanda to reasonably conform with existing zoning districts adjacent thereto when and if such current property uses are discontinued. Said rezoning shall be approved prior to any and all redevelopment of such properties.
