The SM-AG District is intended for those areas where surface mining operations have been established as an appropriate use. Surface mining is only permitted in the SM-AG District. Uses permitted in the AG District are permitted in the SM-AG District to allow for productive use of the land following reclamation of mined areas. Surface mining operations are subject to the regulations outlined in §
140-98.
The following uses are permitted in the SM-AG District:
C. Forestry, lumbering and reforestation.
D. Game farms, fish hatcheries and fishing reserves.
E. Generalized or specialized farms.
F. Nurseries, orchards, greenhouses, vineyards.
G. Roadside stands, including only movable or temporary structures for
the sale of agricultural products grown principally by the operator
during the harvest season.
H. Single-family detached dwellings.
I. Wildlife sanctuaries, woodland preserves, arboretums.
The following are the accessory uses, buildings and structures
permitted in the SM-AG District, provided that such accessory uses
and buildings shall not be constructed until the permitted use has
been established:
A. Decks, terraces and patios located in the side or rear yard.
B. Dish antennas three feet or less in diameter.
C. Farm-related buildings for the storage of products or equipment.
E. Home occupations, low-intensity.
F. Private detached garages, carports, pool houses, gazebos, patio covers, signage in accordance with §
140-129.
G. Storage of no more than two recreation vehicles/utility trailers, except for items stored indoors, provided they comply with §
140-128.
H. Wind energy conversion systems (noncommercial) subject to the provisions of §
140-108.
I. Other customary residential structures, including but not limited
to private swimming pools, storage sheds, domestic pet shelters and
fireplaces as associated with a farm dwelling.
The following uses are allowed in the SM-AG District subject
to site plan review:
A. Adult family day-care homes.
B. Family and group family day-care homes.
D. Public and semipublic facilities.
The following are special permit uses in the SM-AG District:
F. Home occupations, high-intensity.
H. Surface mining operations, subject to the additional requirements set forth in §
140-98.
I. Wireless communications facilities/towers in accordance with §
140-109.
J. Any use or business not specifically mentioned in this chapter which,
in the opinion of the Planning Board, is similar in nature and scale
to a use or business permitted within the SM-AG District listed above.
The following lot, area and yard requirements apply to the SM-AG
District:
A. Minimum lot width.
(1) Residential uses: 200 feet.
B. Lot area requirements.
(1) Residential uses:
(a)
Minimum lot area, single-family dwelling: two acres.
(b)
Maximum lot coverage: 35%.
(2) Other uses:
(a)
Minimum lot area, farm: 10 acres.
(b)
Maximum building coverage: 10%.
(c)
Maximum lot coverage: 15%.
C. Yard requirements.
(1) Residential and nonresidential uses:
(a)
Minimum front yard setback: 75 feet.
(b)
Minimum side/rear yard setback: 25 feet on each side.
(2) Accessory uses:
(a)
Minimum front yard setback: 75 feet.
(b)
Minimum side/rear yard setback: 20 feet.
D. Corner lots. For corner lots, both yards abutting streets shall be
considered front yards and shall follow the regulations of this article;
all side and rear yards shall follow the regulations of this article.
The following requirements apply to buildings constructed in
the SM-AG District:
A. Maximum building heights.
(1) Residential uses:
(a)
Farm dwelling: 2 1/2 stories not to exceed 35 feet.
(b)
Other farm structures: 100 feet.
(2) Nonresidential uses:
(a)
Farm dwelling: 2 1/2 stories not to exceed 35 feet.
(b)
Other farm structures: 100 feet.
B. Minimum floor area.
(1) Residential uses.
(a)
Principal use:

More than one story: 1,400 square feet.

Other uses: 1,000 square feet.
