The Board of Supervisors is hereby authorized and empowered to enter
into a contract or contracts with Chester Water Authority and/or United Water
Bethel Company for the placing, replacing, operating, maintaining and repairing
of fire hydrants in the Township of Concord to be connected to water mains,
maintaining pressures approved by the Fire Insurance Underwriters of the Commonwealth
of Pennsylvania along certain highways, streets, roads and alleys within the
Township to provide fire protection service to and for the fire hydrant districts
hereinafter designated.
There is hereby created, designated and established within the township
fire hydrant districts, as shown and marked on a plan thereof made for the
township, designated as the "Township of Concord Fire Hydrant District Map,"
prepared by Van DeMark & Lynch, Inc., and dated November 15, 1996 (being
Sheet 1 of 15), which is attached hereto, made a part hereof and marked Exhibit
A, and said districts are designated thereon as follows:
A. Chester Water Authority service area.
B. United Water Bethel Company service area.
The moneys necessary for fulfilling the contract obligations with Chester
Water Authority and/or United Water Bethel Company with respect to such fire
hydrants and such fire protection service shall be assessed as follows:
A. The Township Supervisors, by resolution, shall annually
assess or cause to be assessed the cost and expense of such fire protection
service by an equal assessment upon all property, whether or not exempt from
taxation by existing law, abutting upon said highways, streets, roads and
alleys or portions thereof and upon property within 780 feet of any fire hydrant
in the district benefited thereby and/or connected to a water main in the
district, based upon the assessment for county purposes. No such assessment
shall be levied against any farmland or land used as an aviation field or
against other property in the district not benefitted thereby.
B. Such assessment, including an amount equal to the cost
of collection, shall be collected in the same manner as taxes. The Township
Tax Collector shall receive the same commission as on the township tax. The
Township Treasurer shall receive all such assessments collected for fire protection
and shall keep the same in a separate account and shall pay the same out only
upon orders signed by the Chairman of the Board of Supervisors, attested by
the Township Secretary. The Township Treasurer shall make a report to the
auditors of the township annually.
