The Superintendent and any other duly authorized employees of
Cuba Village bearing proper credentials and identification shall be
permitted to enter all properties for the purposes of inspection,
observation, measurement, sampling and testing in accordance with
the provisions of this Part 1. The Superintendent or his/her representatives
shall have no authority to inquire into any processes including metallurgical,
chemical, oil, refining, ceramic, paper or other industries beyond
that point having a direct bearing on the kind and source of discharge
to the sewers or waterways or facilities for waste treatment.
Any person found to be violating any provisions of this Part
1 shall be served by the village with written notice stating the nature
of the violation and providing a reasonable time limit for the satisfactory
correction thereof. The offender shall, within the period of time
stated in such notice, permanently cease all violations.
Any person who shall continue any offense beyond the time limit provided for in Article
VI, §
155-37, above shall be guilty of a violation pursuant to the Penal Law, punishable by a fine of not more than $250 or imprisonment for not more than 15 days, or by both such fine and imprisonment. The continuation of an offense shall constitute, for each day the offense is continued, a separate and distinct violation.
The Village Attorney, at the request of the Superintendent,
shall have the right to seek equitable relief, in the name of the
village, to restrain the violation of or to compel compliance with
any order or determination issued thereunder by the Superintendent.
Any person violating any of the provisions of this Part 1 shall
become liable to Cuba Village for any expense, loss or damage occasioned
the village by reason of such violation.
