A.
The Superintendent and/or the Director or other duly
authorized employee of the Town and/or of the county bearing proper
credentials and identification shall be permitted to enter all properties
for the purposes of inspection, observation, measurements, sampling
and testing the quantity and quality of waste discharges to the sewers
or waterways or facilities for waste treatment in accordance with
the provisions of this chapter.
B.
The Town may at reasonable times have access to and
copy any records, inspect any monitoring equipment, or method required,
by wastewater discharge permits or Town ordinance and sample any effluent
which the owner or operator of such source is required to sample.
Where a user has security measures in force, the user shall make necessary
arrangements with their security guards so that upon presentation
of suitable identification, personnel from the Town will be permitted
to enter without delay.
The Superintendent and other duly authorized
employees of the Town bearing proper credentials and identification
shall be permitted to enter all private properties through which the
Town holds a duly negotiated easement for the purposes of, but not
limited to, inspection, observation, measurement, sampling, repair
and maintenance of any portion of the sewerage works lying within
said easement. All entry and subsequent work, if any, on said easement,
shall be done in full accordance with the terms of the fully negotiated
easement pertaining to the private property involved.
The Town is authorized to issue an order to
cease and desist and direct those persons not complying with such
prohibitions, limits requirements or provisions of this chapter or
