No gasoline pump shall be installed, maintained, operated, suffered
or permitted to remain on any public street or sidewalk in the village unless
a permit therefor has been issued by the Board of Trustees.
No permit to install, maintain or operate a gasoline pump shall be issued
except to a person lawfully conducting a gasoline service station in connection
with which a gasoline pump or pumps were maintained and operated on the public
street or sidewalk at the time of the adoption of this article, and no such
permit shall be issued for the maintenance and operation of any gasoline pump
except inside of the curb immediately adjacent to the premises on which such
gasoline service station is operated, nor shall a permit be issued for the
maintenance and operation of more than two pumps in connection with any gasoline
service station.
Permits shall be issued for a calendar year expiring on December 31
of each year, upon application of the person conducting a gasoline service
station, which application shall be approved by the owner of the premises
on which such station is conducted upon payment of a fee to be determined
by the Village Board by resolution and set in the fee schedule. Such permit shall be revocable by the Board of Trustees at any
time, and for the year 1957 shall be issued from the effective date of this
article to January 1, 1958, at the same fee prescribed for the calendar year.
No gasoline pump shall be maintained or operated so as to obstruct or
impede passage of any sidewalk, except that if the sidewalk extends to the
curb, such pump shall extend not more than 30 inches from the curb unless
the Board of Trustees specifically provides for a different location in the
permit to be issued, and no automobile or other vehicle being serviced from
such gasoline pump shall be parked or permitted to be, in whole or in part,
on any sidewalk, nor shall any equipment or other articles be displayed for
sale or left standing or be placed anywhere in the area of the street or between
the curb and property line of the building.
Violation of the provisions of this article shall be punishable by revocation
of operator's permit or permits and by a fine of $25 for each day during
which the violation exists.
No person, firm or corporation, including any division, subsidiary or
affiliated entity, shall be allowed to store in bulk more than an aggregate
of 20,000 gallons of gasoline in the Village of Hastings-on-Hudson, New York.
As used in this article, the following terms shall have the meanings
indicated:
GASOLINE
An inflammable mixture, liquid or any substance or compound which
will emit an inflammable vapor at a temperature below 100° F., when tested
in a Tagliabue open cup tester.
Any person, firm or corporation violating this article shall be subject
to a penalty of not more than $250, 30 days' imprisonment or both. Each
day of such storage shall constitute a separate violation.
