The purpose of this chapter is to promote the health, safety, morals
and general welfare of the community, including the protection and preservation
of the property of the Town of Inlet and of its inhabitants by establishing
specific requirements and regulations governing a person while entertaining
or performing in a play, exhibition, show or entertainment, by specifically
eliminating the exceptions found in §§ 245.01 and 245.02 of
the Penal Law of the State of New York relating to persons who are entertaining
or performing in a play, exhibition, show, or entertainment.
This chapter is enacted pursuant to §§ 245.01 and 245.02
of the Penal Law of the State of New York and Article 2 of the Municipal Home
Rule Law.
For the purpose of this chapter, the following words, terms, and phrases
shall have the following meanings ascribed:
PERSON
An individual, firm, partnership, corporation, voluntary association,
incorporated association, and any principal, agent, or employee thereof.
PRIVATE OR INTIMATE PARTS
The showing of the human male or female genitals, pubic area or buttocks,
with less than a full opaque covering, or the showing of the female breasts
with less than a full opaque covering of any portion of the breast below the
top of the nipple and areola, or the depiction of the covered male genitals
in a discernible turgid state.
PUBLIC PLACE
A place to which the public or a substantial group of persons has
access and includes but is not limited to highways, transportation facilities,
schools, places of amusement, including restaurants, nightclubs, cocktail
lounges, and similar establishments, parks, and playgrounds.
Any person who violates any provision of this chapter shall be guilty
of an offense against this chapter and subject to a fine of not less than
$250 nor more than $500, or to imprisonment for a period of not more than
30 days, or both fine and imprisonment.
This chapter may be enforced by any law enforcement agency of the Town
of Inlet, County of Hamilton, or State of New York.
