No person, firm or corporation shall keep or store manure within 200 feet of any inhabited dwelling within the Village except in flytight and airtight sanitary receptacles, such as concrete pits, and then only by written permit from the Village Building Inspector and in accordance with the terms of such permit and the regulations of the Nassau County Department of Health. Such receptacles shall not be constructed or used until plans and specifications therefor shall have been filed with and approved by the Village Building Inspector.

Notwithstanding the provisions contained in § 94-3 of this article, a person, firm or corporation may maintain a compost pile on his or its property, meeting the following specifications:
A. 
Location. A compost pile may be located only in a rear yard and be accessory to an existing one-family dwelling located on the same lot or premises. In no event shall it be located within 20 feet of a property line.
B. 
Size. The total area of the compost pile or piles on any one lot or premises shall not exceed 100 square feet per acre. In no event shall the top of the pile be more than three feet above the surrounding grade.
C. 
Screening. All compost piles shall be screened from neighboring properties by a living screen of coniferous shrubs or bushes or by a stockade-type of fence.
D. 
Composition of pile. A compost pile shall contain only the following materials and substances: leaves, small branches, garden clippings, dry grass clippings, weeds, straw, hay, sawdust, lime, soil and dry chemical fertilizers.
E. 
The compost pile shall be built and maintained in such a manner as to prevent:
(1) 
The breeding or nesting of flies or vermin.
(2) 
The emission of any noxious or offensive odors.

Upon recommendation of the Nassau County Department of Health, the Building Inspector of the Village may, at any time, revoke a permit issued as provided in § 94-3 of this article by reason of any unsanitary or unhealthful conditions existing or created by the use or maintenance of any pit or other receptacle for the storage or disposal of manure.
