As used in this article, the following terms shall have the meanings indicated:
PARKING
The leaving of any vehicle unattended within the highway right-of-way of any highway located within the boundaries of the Town of Livonia.
PERSON
An individual, association, partnership or corporation or any combination thereof and the agent or employee thereof.
STANDING
The allowing of any vehicle to remain at a particular location for any period of time in excess of that period of time required to accept or discharge passengers or in excess of that period of time required to obey any traffic control device, sign or regulation.
A. 
Upon his or her own motion, the Highway Superintendent of the Town of Livonia shall cause to be prepared a listing of areas upon the highways within such town at which parking or standing is unsafe, and the Highway Superintendent shall determine during what times of day or night and between what dates in the year such parking or standing shall be unsafe in such locations. The Highway Superintendent shall prepare a list of such places within the Town of Livonia and shall transmit such list to the Town Board of the Town of Livonia with his or her recommendations as to the establishment of no-parking zones in accordance with such list.
B. 
Upon receipt of such list, the Town Board shall review the same and may tentatively accept such recommendations in whole or in part.
C. 
The Town Board shall then set the date for a public hearing, the notice for which shall be published in the official newspaper of the town at least five days prior to said hearing.
D. 
Such notice shall include a description of the proposed area where parking shall be limited, together with the times or dates of limitation.
E. 
Subsequent to said hearing, the Town Board may establish the zones or zone in which parking or standing shall be restricted and the nature of such restrictions.
F. 
At any time that restrictions are proposed for a state or county highway, the Town Board shall consult with the appropriate authorities before final adoption of such restrictions.
G. 
Upon the adoption of such restrictions, the Town Highway Superintendent shall cause to be posted, at the locations of the restrictions, signs advising the public of such restrictions. Such signs shall be in the form and contain the legends approved by the State Department of Transportation and the Livingston County Highway Department.
A. 
This chapter will be enforced by the local law enforcement agency. Any violation of any restrictions when properly posted and adopted shall be punishable as provided by the Vehicles and Traffic Law of the state.[1]

B. 
In the event that any police agency shall determine that a vehicle parked or standing in violation of this article constitutes an immediate hazard to person or property, such police agency may cause to be called a towing agency authorized by the Town Board for removal of such vehicle. The charge for such removal and storage shall be against the owner of the vehicle, and such vehicle may not be reclaimed without the payment of such charge. The charges of such removal and storage shall be established from time to time by resolution of the Town Board of the Town of Livonia.
C. 
In addition to the penalties herein provided, the Town Board may also maintain an action or proceeding in the name of the town in a court of competent jurisdiction to compel compliance with or to restrain by injunction any violation of this article.
D. 
No person shall allow a vehicle to park or stand in contravention of the terms of this article and the signs and/or regulations implementing this article.[2]
