As used in this article, the following terms shall have the meanings indicated:
AWWA
American Water Works Association.
CONSUMER
The owner of the property receiving the service.
WATER DEPARTMENT
The duly authorized representative of the Town Board responsible for the maintenance and operation of the water system.
A. 
Any consumer desiring water service shall make application in writing for the same to the Water Department of the Town of Livonia or to any other representative of the Town Board as may be designated by the Board to receive such application, and any consumer desiring the discontinuance of water service shall also make application in writing to the Water Department or other duly authorized representative of the Town Board stating the date the consumer desires discontinuance to begin.
B. 
The consumer shall pay the appropriate fee for service or discontinuance of service in accordance with the Fee Schedule in effect at the time the application is made. Payment shall be made at the time the application is made. The Fee Schedule will be adopted by the Town Board of the Town of Livonia by resolution.
A. 
The tapping of the supply main and the installation of the necessary connections, including but not limited to the corporation stop, curb stop, curb box and service line between the main and the curb box, will be performed by the Water Department. The water service meter will be provided by the Water Department for installation by the consumer in accordance with guidelines provided by the Water Department. Backflow prevention devices will be provided as required in Chapter 142, Article I, Backflow Prevention Devices.
B. 
At the request of the consumer, water service will be shut off at the curb box and turned back on seasonally. Water charges will continue to be assessed during the period of temporary shutoff.
C. 
The town is responsible for the maintenance of water service lines and appurtenances from the main to the curb box or the highway right-of-way or easement line, whichever is closest to the main. The consumer is responsible for maintenance of the water service from this point to the point of use. If the consumer fails to correct any leak or other problem with the portion of the water service within this area, the Water Department will complete the repair and bill the consumer for the associated costs.
A. 
Residential.
(1) 
Water service shall be separately charged to each dwelling unit. A dwelling unit shall include single-family residences, mobile homes and individual apartments in a multiple-dwelling structure with three or fewer units. Multiple single-family dwellings on the same parcel of land will each be considered as an individual service unit.
(2) 
In multiple-dwelling structures with four or more apartments, the number of service units will be determined as follows:
(a) 
The number of service units will be equal to the number of dwelling units when each dwelling unit is metered with an individual water meter.
(b) 
When a single, master meter is installed in lieu of individual meters, the number of service units will be determined based on the size of the water meter required to allow a maximum pressure loss of 15 psi at the safe maximum operating capacity in accordance with current American Water Works Association (AWWA) standards. The determination of the size of water meter required will be provided by the consumer. The minimum number of service units in this situation is three units, regardless of the size of meter actually installed. The determination of meter size will be made in accordance with commonly accepted methods and will be subject to the review and concurrence of the Water Department.
B. 
Nonresidential. Nonresidential, recreational, commercial, industrial, institutional and agricultural facilities will be assigned a number of service units based on the size of the water meter required to allow a maximum pressure loss of 15 psi at the safe maximum operating capacity in accordance with current American Water Works Association (AWWA) standards. The determination of the size of water meter required will be provided by the consumer. This determination will be made in accordance with commonly accepted methods and will be subject to the review and concurrence of the Water Department. The minimum number of service units is one unit.
C. 
Seasonal.
(1) 
Campgrounds and short-term seasonal rental properties are those properties which are used for short-term seasonal use on a rental basis and are part of a group of more than one unit on a single property. They are income-producing units which are not occupied more than four months of the calendar year. One unit of the complex may be used on a nonseasonal basis and can be occupied more than four months of the year.
(2) 
Properties meeting this criteria will be metered on a master meter basis with one meter serving the entire parcel. The minimum number of service units for a property meeting this criteria is 1 1/2 units. The actual number of units will be established based on the size of the water meter required in accordance with § 145-4B. If additional meters are required, each meter provided will result in an additional service unit being charged. The number of units determined above will be charged to the consumer on an annual basis without regard to the seasonal usage of the units on the property.
Water shall not be delivered to any consumer unless a water meter provided by the Water Department and installed in accordance with Water Department requirements is in place.
A. 
All consumers of water within the Livonia Center Water District shall be charged for water by a combination of the two following methods:
(1) 
Ad valorem. Each owner of real property within the Livonia Center Water District who benefits from the water supply and distribution system of the Town of Livonia will pay an ad valorem charge for water service to be charged with and paid annually as part of the town tax assessed to that real property.
(2) 
Consumption charge. The consumer responsible for each water service will be responsible for payment of the charge for a minimum of 10,000 gallons per service unit for each three-month period regardless of the actual amount of water used. In addition, the consumer will also be responsible for payment for all water used in any one quarter which is in excess of the minimum amount. The additional amount due will be computed based on the actual quantity of water used in one-thousand-gallon increments as measured by the consumer's water meter. These charges will be billed and paid quarterly.
(3) 
Other charges. The Town Board of the Town of Livonia may, from time to time, add additional water-related charges to a consumer's quarterly bill resulting from the following:
(a) 
Unpaid water service application fees.
(b) 
Charges related to the installation or repair of water services not the responsibility of the Water Department.
(c) 
Other charges that the Town Board may determine as applicable to the consumer's use of the water system.
(4) 
Water rates. The ad valorem rate and the water consumption rate will be determined by the Town Board of the Town of Livonia. All charges will be computed in accordance with the rate schedule in effect at the time the water is used.
(5) 
Unpaid water bills. When the water bill for any consumer remains unpaid for more than 90 days after the mailing of the quarterly water bill, the water of such consumer may be turned off, if so decided by the Town Board. All water bills remaining unpaid at the end of a town fiscal year shall be added to the next town tax and shall become a lien upon the real property to which water service was furnished.
B. 
For consumers outside the corporate limits of the Livonia Center Water District, all charges related to water service shall be paid quarterly. The charge for water will be as follows:
(1) 
Out-of-district user charge. This annual charge will be computed by using the ad valorem tax rate in effect for the Livonia Center Water District and multiplying it by the current assessed valuation of the real property where the service is being rendered. The annual charge will be divided by four to determine the quarterly charge.
(2) 
Consumption charge. The consumer responsible for each water service will be responsible for payment of the consumption charge as described in Subsection A(2).
(3) 
Other charges. The Town Board of the Town of Livonia may, from time to time, add additional water-related charges to a consumer's quarterly bill resulting from the following:
(a) 
Unpaid water service application fees.
(b) 
Charges related to the installation or repair of water services not the responsibility of the Department.
(c) 
Other charges that the Town Board may determine as applicable to the consumer's use of the water system.
(4) 
Water rates. The ad valorem rate and the water consumption rate will be determined by the Town Board of the Town of Livonia. All charges will be computed in accordance with the rate schedule in effect at the time the water is used.
(5) 
Unpaid water bills. When the water bill for any nonresident consumer remains unpaid for more than 90 days after mailing of the quarterly water bill, the water of such consumer may be turned off, if so decided by the Town Board, and the Town Board shall direct the Town Attorney to take whatever steps are necessary to collect the unpaid balance.
All meters shall be furnished and kept in necessary repair by the Water Department. In new installations, the water meter shall be installed by the consumer. In the case of replacement meters in existing installations, the Water Department may, at its discretion, chose to install the replacement meter or require the consumer to complete the installation. The installation and all valves, fittings and other appurtenances are the responsibility of the consumer.
The Town Board of the Town of Livonia will, from time to time, put into place rules and regulations which it deems necessary for the efficient operation of the water supply system. It may also adopt design criteria, construction specifications, standard construction details and standard materials and appurtenances as it deems necessary. In addition, the Town Board authorizes the Town of Livonia Water Department to determine the policies and procedures necessary to comply with all federal, state and local requirements applicable to the construction, operation and maintenance of the Town of Livonia water system.
