This chapter shall be entitled a "Local Law for Regulating Recycling,
Solid Waste Collection and Deposit at the Town's Recycling and Solid
Waste Transfer Station."
The purpose of this chapter is to permit the Town of Lloyd to regulate
the station and regulate the storage, collection, transportation and deposit
of garbage and refuse materials of all types to be recycled or otherwise disposed
of at the Town transfer station in the most efficient manner possible.
The Town Board has been given authority by Town Law § 130
to regulate in protection of the public health, safety and welfare.
As used in this chapter, the following terms shall have the meanings
indicated:
RECYCLABLES OR RECYCLABLE MATERIALS
Newspaper, glass bottles and jars, metal cans, plastic bottles and
jugs, corrugated cardboard and any other materials as may be designated by
the Ulster County Resource Agency or other agencies or the Town.
SCAVENGE
The handling, moving or removal of any matter which has been placed
in the recycling or solid waste transfer station, except for authorized rehandling
and rearranging done by Town employees, or at their direction.
SOLID WASTE
All materials or substances discarded or rejected within the Town
as being spent, useless, worthless or in excess to the owners at the time
of such discard or rejection, including but not limited to garbage, refuse,
waste, residue, demolition and construction debris, but not including sewage
and other highly diluted water-carried materials or substances and those in
gaseous form, source, special nuclear or by-product material within the meaning
of the United States Atomic Energy Act of 1954, as amended, waste which appears
on the list of hazardous waste promulgated by the Commissioner of Environmental
Conservation Law of the State of New York and scrap or other material of value
separated from the waste stream and held for purposes of materials recycling,
as such definition may be amended from time to time by the state.
