The disposal of solid waste or any other materials set forth in § 82-4, or any hazardous or toxic materials which have been conveyed into, brought or collected from areas outside the Town of Lloyd, is prohibited.
Domestic, nonhazardous solid waste under two cubic yards per each delivery are to be deposited in designated containers called "roll-offs," available at the transfer station, under the direction and supervision of the Town of Lloyd's employees and agents, during hours and days set by the Town Board of the Town of Lloyd.
No construction and demolition materials are allowed in the Town of Lloyd transfer station, and same are prohibited from being deposited. Any load of other bulky wastes under two cubic yards is allowed, but any load over two cubic yards shall be hauled to the Ulster County Resource Recovery Agency station in New Paltz or Kingston.
Appliances, scrap metal, tires, large furniture pieces, lockers, drums and tanks with ends cut, electronic equipment, nonrecyclable plastics and other nonrecyclable composite materials shall be left at the transfer station in areas as designated by the Town of Lloyd's agents and employees, and a fee made payable in accordance with the schedule as adopted and amended by the Town Board. No junk cars will be accepted at the transfer station.
Logs over six inches in diameter or six feet in length and all stumps are prohibited from deposit in the transfer station. Residents are directed to chip, chop, saw or otherwise reduce the size or obtain the New York State Department of Environmental Conservation authority to dispose of the same. Smaller-sized yard wastes, brush, grass and leaves are accepted at the transfer station.
Regulated recyclable materials are to be source-separated and collected, then transported to the Town recycling center, in accordance with the rules and regulations of the New York State Department of Environmental Conservation, Ulster County Board of Health, Ulster County Resource Recovery Agency and this chapter of the Town of Lloyd Code. The Town shall issue to all residents one or more blue recycling containers for use in protecting recyclables after separation and prior to hauler pickup or self-delivery to the recycling center. Such containers shall remain with the housing unit and remain the property of the issuing agency. The Ulster County Resource Recovery Agency and the Town of Lloyd Town Board shall prepare and disseminate to the public interest and may amend such instructions from time to time. Such instructions when adopted by the Town Board shall be enforced as law pursuant to this section of the Town Code.
No garbage, refuse, recyclables or other solid wastes nor materials permitted to be disposed of in the Town transfer station shall be brought upon the Town solid waste center unless fully covered and secured against falling from the vehicle in which it is carried.
Hours of operation shall be set and amended by the Town Board, and signs shall be placed at the entrance to the Town transfer station and recycling center.
No vehicle shall be operated on the Town solid waste and recycling center grounds property at a rate of speed in excess of a limit, as posted. The speed limit shall be set and amended by the Town Board by resolution.
The entering upon any part of the Town solid waste and recycling property off Lily Lake Road, except at the gate provided for that purpose and during the hours designated by signs, is prohibited.
No person shall remain upon the Town solid waste and recycling center off Lily Lake Road after he or she shall have disposed of the garbage, recycling or other waste brought by him for disposal nor enter or remain on said grounds when not engaged in disposal of garbage, recyclables or other solid waste.
No person shall be allowed to hunt nor to bring, carry or discharge any firearms, air rifles or other weapons on the Town solid waste and recycling lands off Lily Lake Road.
No person, except the person employed by the Town and placed in charge of the Town properties used for solid waste and recycling off Lily Lake Road, shall kindle or light or cause to be kindled or lighted or set any fire upon said lands.
No person shall scavenge upon any part of the lands of the Town used for solid waste disposal and recycling off Lily Lake Road. All items deposited at the solid waste and recycling center are the property of the Town of Lloyd.
No person shall bring or leave or deposit on any part of the Town's solid waste and recycling center off Lily Lake Road any explosive, radioactive or hazardous materials, industrial wastes or any other substance or material other than municipal solid waste, as defined in 6 NYCRR Part 360-1.2(b) (106), regulated recyclable materials as defined in the Ulster County Local Law No. 8 of 1991 or other recyclable materials as may be authorized by the Town of Lloyd.
All garbage and household solid wastes, which cannot be recycled, must be deposited in the transfer station roll-offs in tied bags only. The Town Board by resolution may set the standard size and transparency, and any per-bag fee, from time to time. The Town reserves the right to inspect any bag at any time.
The recycling and solid waste transfer center shall be supervised by the Town Highway Superintendent for the Town Board or by any other designee appointed by the Town Board. An attendant may also be appointed by the Town Board, and if so appointed, it is his or her responsibility to enforce such regulations herein as affect the deposit of solid waste and recyclables at the center. He or she shall refuse admission to the site to all persons and vehicles not in compliance with the regulations and shall call the police if assistance is needed and if complaints are to be made for breach of these regulations. He or she is not authorized to grant any exceptions but must refer unusual situations to his or her supervisor, who will report it to the Town Board for action. The attendant shall punch all tickets purchased from the Town Clerk and any miscellaneous fees for bulky solid wastes and white goods set forth above.
Nothing set forth in this chapter shall apply to the use as a transfer and recycling station of the former Town of Lloyd dumping ground or impair the contractual agreements made with the Ulster County Resource Recovery Agency, dated May 15, 1993, and this chapter of the Code shall supplement the powers of the Ulster County Resource Recovery Agency in monitoring the former dumping ground after it was closed and landscaped by said agency pursuant to agreements with the Town Board of the Town of Lloyd and the New York State Department of Environmental Conservation.
