This chapter shall be known as "Local Law No. 3 of the Year 1988, Creating the Position of Electrical Inspector and Setting Forth Duties and Violations Thereunder."
A. 
Any electrical inspector under the employ of any electrical inspection company duly licensed by the State of New York is hereby authorized to make electrical inspections in the Town of Mamakating. In no event will the cost or expense of making such inspections and/or reinspections be a charge against the Town of Mamakating.
B. 
The Building Inspector and/or the Fire Code Enforcement Officer of the Town of Mamakating is hereby designated as the building official of the Town of Mamakating.

A. 
It shall be the duty of the building official to enforce all provisions of this code, all violations or deviations from or omissions of the electrical provisions of the New York State Uniform Fire Prevention and Building Code applicable to the Town of Mamakating and of all local laws, ordinances and the Town of Mamakating Building Code as referred to in this chapter insofar as any of the same apply to electrical installations or inspections in or on properties in the Town of Mamakating.

B. 
It shall be the duty of the aforementioned inspector employed by any New York State licensed electrical inspection company to register with the building official and leave with the building official his credentials and certifications and to report, in writing, to the building official the nature and location of the inspection to be made.
(1) 
After notification to the building official, said inspector will be authorized to make inspections and reinspections of electrical wiring installations, devices, appliances and equipment in or on properties within the Town of Mamakating.
(2) 
It shall be the duty of said inspector to furnish written reports to the building official of the Town of Mamakating and owners and/or lessees of the property inspected, which said report shall detail the findings of the inspector, including defective electrical installations and equipment wherever found upon his inspection. If the inspector finds the premises in question to be in conformity with applicable state and local laws and ordinances, he shall recommend to the building official the issuing of a certificate of compliance with the understanding that the building official may rely upon such reports and recommendations of the inspector, so that in the event that said inspector's report is inaccurate in reporting the conditions found by the inspector, neither the Town of Mamakating nor the building official nor any employees of the Town of Mamakating shall be responsible for any damages resulting therefrom.
(3) 
It is the inspector's duty and obligation to be answerable solely to the homeowner, lessee and/or electrician therefor who retained the services of said inspector and to hold the Town of Mamakating harmless and indemnify the same in the event of any damages resulting to the premises in question as a result of any deficiencies or defects in the report supplied to the building official by said inspector.
A. 
It shall be a violation of this chapter for any person, firm or corporation to install or cause to be installed or to alter electrical wiring for light, heat or power in or on properties of the Town of Mamakating until an application for inspection has been filed with the building official and any approved electrical inspection company licensed in the State of New York.
B. 
It shall be a violation of this chapter for a person, firm or corporation to connect or cause to be connected electrical wiring in or on properties for light, heat or power to any source of electrical energy supply prior to the issuance of a temporary certificate and a reinspection by the inspector for any approved electrical inspection company. Said inspector shall issue a certificate of compliance to the building official, who shall then issue a certificate of compliance on behalf of the Town of Mamakating upon his review and approval of the certificate of compliance issued by and on behalf of said approved electrical inspection company.

Any person who violates any provision of this chapter shall, upon conviction thereof, be subject to a fine not to exceed $1,000 or to imprisonment for a term not to exceed one year, or both.
