It has been determined that a large portion
of the Town of Manchester, not being afforded a public water supply,
is dependent upon wells many of which are shallow or dug wells. It
is the intent of this Town Board to promote, preserve and protect
the public health, safety and welfare within the Town by preserving
the integrity of these sources of water.
No animal wastes shall be stockpiled or stored
upon lands other than those from which such animal wastes originate
except pursuant to the terms of a written permit therefor issued by
the Town of Manchester upon application to the Zoning Officer of said
Town or such other officer or employee of the Town as this Board may
so designate from time to time.
The Town Board, by resolution, may establish
reasonable conditions regulating the stockpiling or storage of such
animal waste, terms of such permit, permit fee and revocation of permit.

If no other penalty for violation of any part
of this article or orders issued in compliance with this article is
provided otherwise by law, a person violating such part of this article
or such orders shall be punishable by a fine of $250 or imprisonment
not to exceed 15 days, or both, and each week such violation continues
shall constitute a separate violation, carrying with it a fine of
$50 for each additional day the violation continues.
In case land is used in violation of this article
or of any regulation made under authority conferred hereby, the Town
Board or, with its approval, the Zoning Officer or other proper official,
in addition to other remedies, may institute any appropriate action
or proceedings to prevent such unlawful use, to restrain, correct
or abate such violation or to prevent any illegal act, conduct, business
or use in or about such premises.
