A. 
The intent of this chapter is to establish the requirement of an inspection and approval for all electrical wiring, services, circuits, and directly wired equipment and appliances.
B. 
The purpose is to protect the health, welfare and safety of the public and provide safety from electrical fires and shock.
The Chief Inspector of each of the duly authorized inspection agencies is hereby authorized and deputized as agents of the Town of Manchester to make inspections and reinspections of all electrical installations hereafter described, and to approve or disapprove the same. In no event, however, will the cost of expense of such inspections and reinspections be a charge against the Town.
A. 
It shall be the duty of the Inspector to report to the Zoning Officer all violations of or deviations from or omissions of the electrical provisions of the New York State Uniform Fire Prevention and Building Code and the National Electrical Code (NFPA-70). The Inspector shall make inspections and reinspections of electrical installations in and on properties in the Town upon the written request of the Zoning Officer or the property owner.
B. 
In the event of an emergency, it is the duty of the Inspector to make electrical inspections upon the oral request of an official or officer of the Town.
C. 
It shall be the duty of the Inspector to furnish written reports to the proper officials of the Town and owners and/or lessees of property where defective electrical installations and equipment are found upon inspection.
D. 
He shall authorize the issuing of a certificate of compliance when electrical installations and equipment are in conformity with the New York State Uniform Fire Prevention and Building Code and with the National Electrical Code (NFPA-70) and he shall direct that a copy of the certificate of compliance be sent to the Zoning Officer.
A. 
The agency shall file with the Zoning Office the following information:
(1) 
The Inspector's name and phone number.
(2) 
The agency's main office address and phone number.
(3) 
Information to show that the agency's Inspector is fully qualified to interpret and administer the applicable electrical codes required in New York State.
(4) 
The schedule of rates charged for inspections.
B. 
Failure to provide this information shall disqualify any agency from making any electrical inspections within the Town of Manchester.
This chapter shall not be construed to relieve from or lessen the responsibility of any person owning, operating, controlling or installing any electrical wiring, devices, appliances or equipment for loss of life or damage to person or property caused by any defect therein, nor shall the Town or the authorized agencies be deemed to have assumed any such liability by reason of any inspection made pursuant to this chapter.
It shall be a violation of this chapter for any person, firm or corporation to install or cause to be installed, or to alter or repair, electrical wiring for light, heat or power, in or on properties in the Town until an application for inspection has been filed with the authorized inspection agency.
If no other penalty for violation of any part of this chapter or orders issued in compliance with this chapter is provided otherwise by law, a person violating such part of this chapter or such orders shall be punishable by a fine of $250 or imprisonment not to exceed 30 days, or both, and each day such violation continues shall constitute a separate violation, carrying with it a fine of $50 for each additional day the violation continues. An action or proceeding in the name of the Town of Manchester may be commenced in any court of competent jurisdiction to compel compliance with or to restrain violation of this chapter or orders issued in compliance with this chapter.
