Pursuant to Laws of 1978, Chapter 495, Section 150.10, approved and
effective July 20, 1978, and pursuant to the Municipal Home Rule Law, the Village of Massapequa
Park is hereby authorizing by this chapter the Village Administrator or the
Executive Assistant or the Assistant Superintendent of Public Works or the
village-designated Foreman, as designated, the Building Inspector and the
Complaint Investigator to issue appearance tickets directing a designated
person, corporation, partnership or other entity to appear in the designated
Village Court at a designated time in connection with his, its or their
alleged commission of a designated offense.
The designated officers and agents of the Incorporated Village of Massapequa Park, by virtue of office, title or position as set forth in §
5-1 above, are hereby delegated, authorized and required to issue any appearance ticket as set forth above to enforce any statute, local law, ordinance, rule or regulation relating to parking, licensing of occupations or businesses, fire prevention and safety, health and sanitation, and building, zoning and planning.
A public servant of the Incorporated Village of Massapequa Park, other
than a police officer, who is specially authorized by state law or local law
enacted pursuant to the provisions of the Municipal Home Rule Law to issue
and serve appearance tickets with respect to designated offenses of less than
felony grade, may in such cases issue and serve upon a person, corporation,
partnership or other entity an appearance ticket when he has reasonable cause
to believe that such person, corporation, partnership or other entity has
committed a misdemeanor or has committed a petty offense in his presence.
A notice conforming to such definition constitutes an appearance ticket
regardless of whether it is referred to in some other provision of law as
a summons or by any other name or title.
