A person desirous to conduct a trade, business or calling of a plumber or of plumbing in the Village of Massapequa Park, as employing or master plumber, shall obtain a master plumber's license issued by the Village of Massapequa Park.

The Board of Trustees or its designated representative shall have the power to issue, revoke or suspend plumbing licenses as provided for under this chapter.

No person shall install, alter or repair, or cause to be installed, altered or repaired, any plumbing installation within the scope of this chapter except a person holding a plumber's license as a registered plumber of the village or a person employed by the holder of such a license or a person under the supervision of a holder of such license, except that this chapter shall not apply to any employee of the State of New York or any political subdivision thereof when employed on the business of the State of New York or any political subdivision thereof.
A. 
All applicants for a master plumbing license shall be citizens of the United States and must have attained at least 21 years of age and must be a duly licensed master or employing plumber of either Nassau or Suffolk County municipalities.
B. 
All applications for plumbing licenses shall be made to the Village Clerk.

C. 
Identity of applicant. Each application for a license shall set forth the full name and place of residence of such applicant, each member of the partnership or each officer of the corporation and shall be verified under oath.
D. 
Name of licensee. An application for a license may be made in the name of an individual, partnership or corporation, but the name of the licensee must, in each case, be that of the applicant.
E. 
Photograph. All applications for licenses under this chapter shall be accompanied by a photograph of the applicant, in duplicate, approximately 1 1/2 inches by two inches in size, taken within 30 days prior to the date of filing, such photograph to be affixed to the application and the duplicate to the renewal record card.
F. 
Certificate of registration. Where an applicant for a license intends to conduct business under an assumed or trade name or partnership, there shall be filed, together with the application, a certified copy of the certificate of registration of such name, as required by § 440 of the Penal Law of the State of New York.[1]

G. 
Certificate of incorporation. Where an applicant is a corporation, there shall be submitted, together with an application, a certified copy of the certificate of incorporation and a statement giving the names and addresses of all the officers and stockholders of the corporation. Immediate notice, in writing, shall be given to the Village of Massapequa Park of any change of the identity of such officers and stockholders or any change in their addresses.

H. 
Certificate as to workmen's compensation. All applicants for plumbers' licenses who have employees shall submit with their applications for master plumbers' licenses a certificate of workmen's compensation insurance as required by § 57 of the New York State Workers' Compensation Law.

Before issuing a certificate to engage in the business of master or employing plumber, the Village of Massapequa Park shall inquire into the applicant's fitness and qualifications for conducting such business and may require the applicant to submit, under oath, such evidence as shall satisfy the village that he or she is a person of good repute, character and responsibility and otherwise qualified to engage in business as a master or employing plumber.

The applicant for a certificate of competency shall pay the fee provided in Chapter A350, Fees, which shall accompany the application to cover the cost of his examination, and no part of said fee shall be returned to the applicant if the certificate is not granted.

The Village of Massapequa Park shall, upon application therefor, issue a master plumber's license to the person entitled thereto in accordance with the preceding sections of this Article, and any person to whom the master plumber's license is issued shall register his or her name and address at the office of the Village Clerk.
A. 
All master plumbers' licenses issued under the provisions of the preceding sections of this Article shall expire on the 31st day of December of the year in which they are issued and may be renewed for one year from the first day of January in each year upon application made within 30 days preceding expiration. The master plumber's license of any person failing to renew within the time above specified shall become absolutely void.
B. 
Duty of Village Clerk. It shall be the duty of the Village Clerk on or before the 30th day of October in each year to mail renewal notice and bill to each plumber licensed in the village.
C. 
Failure to receive notice or bill. Failure to receive notice of renewal or bill shall not relieve the licensee from the application of this chapter and shall not constitute a waiver by the village of any of its rights or powers hereunder.
D. 
Renewals of licenses of plumbers entering the Armed Forces or Merchant Marine of the United States shall be extended without charge, to include the year of discharge from such service.
E. 
Any licensed plumber not securing his renewal by the first of January of each year shall be required to make a new application and pay the same fee as for issuance of a master plumber's license.

A fee as provided in Chapter A350, Fees, shall be charged for the issuance of a master plumber's license, and a fee as provided in Chapter A350, Fees, shall be charged for the renewal thereof per year.

A domestic corporation desiring or intending to conduct the trade, business or calling of a plumber or of plumbing in the village, as employing or master plumber, may do so, provided that one or more officers of such corporation separately or aggregately hold and own at least 51% of the issued and outstanding voting stock of said corporation, and provided that each of such officers holding such percentage of the stock is the holder of a master plumber's license issued by the village as provided in § 248-17 of this code. Each and every officer and employee of said corporation shall comply with all rules and regulations applicable to master or employing plumbers in the village. Such corporation shall register at the office of the Village Clerk as provided in § 248-17 of this code and file a copy of registered partnership or corporation papers.
A. 
No person, corporation or copartnership licensed as a master plumber pursuant to this Article shall apply for, receive or make use of any permit granted by reason of such license so as to permit the performance of any plumbing work not done by him or under his immediate supervision.
B. 
Any licensed master plumber shall submit, on request of the Building Inspector, evidence reasonably satisfactory to such Building Inspector that he has not permitted any such work to be done in his name other than by a licensed plumber, and that, in general, he has fully complied with the requirements of this section.

A. 
Every master plumber shall file with the village, before beginning operations under his license and upon each renewal of said license, a surety company bond by a reputable and creditable surety company duly licensed by the State of New York and approved by said village in the minimum sum of $5,000 for a maximum of 10 permits, subject to Subsection B below, indemnifying and saving harmless the village from all damages or claims for damage to a public sewer, water service mains or pipes to highway or the surface thereof, to public or private property or to any person arising from unlawful or negligent acts of omissions of certain master plumbers, their agents or employees or anyone operating under the authority of the license in making connections of any work with a public sewer, in opening a public sewer or in making an opening or excavation in a public highway, public square or public park, or in maintaining, guarding, refilling or working on or about such openings or excavations, or in maintaining or guarding objects or material taken from such openings or excavations or used in connection therewith. Said bond shall remain in full force and effect for a period of two years from the last permit issued against it unless sooner canceled by the village, and said bond shall be and remain security for indemnity for damages as aforesaid during the time it is in force.

B. 
Further, said surety bond shall be issued in the sums indicated below for cumulative connections in excess of the first 10 permitted under the basic bond:

Before any permit is issued, a certificate of public liability insurance of not less than $100,000 per person and $300,000 per accident for personal injury and $50,000 for property damage for each accident and $100,000 aggregate shall be filed with the Incorporated Village of Massapequa Park to cover the village, as a named insured, in the event of any injury to persons or property. Said policy or a renewal thereof must be kept in effect until the completion of all work under the above-mentioned permit and the issuance of the certificate of compliance. In the event that such policy shall expire or be canceled and no replacement is furnished prior to such expiration or cancellation, the permit issued will immediately be revoked. There must be an endorsement on the policy stating that cancellation or material modification to such policy shall not be made unless at least 15 days' prior written notice thereof shall be given by registered or certified mail to the Village Clerk of the Incorporated Village of Massapequa Park.

Before any permit is issued, a certificate of the plumber's current workmen's compensation insurance policy must be filed with the Incorporated Village of Massapequa Park, New York, as required by § 57 of the Workers' Compensation Law, as amended. Said policy or renewal thereof must be kept in effect until the completion of all work under the above-mentioned permit and the issuance of the certificate of compliance. In the event that such policy shall expire or be canceled and no replacement thereof is furnished prior to such expiration or cancellation, the permit issued will be revoked immediately.

Any plumber or his agent wishing to solicit work before his application is received by the village and prior to receiving his village license is required to obtain a solicitor's permit from the Village Clerk in accordance with §§ 240-3 and 240-7 of the Code of the Incorporated Village of Massapequa Park. (Pertinent information on this permit shall include plumber's name, address and his solicitor's/plumber's license number. A card would then be issued by the Village Clerk, which shall then be produced by said plumber or his agent at the request of the resident.)
