A. Resident commuter, merchant, and nonresident commuter.
(1) A fee as determined by resolution of the Board of
Trustees shall be paid upon the issuance of a parking permit which
shall cover a twelve-month period, i.e., June 1 through May 31. Once
a parking permit has been issued, there shall be no refund or partial
refund of the fee paid. A half-year fee shall be applicable as of
December 1.
(2) The issuance of all permits is subject to collection
of all checks received.
(3) Each person desiring to replace a lost parking permit
for the municipal parking fields shall pay a fee of $1.
B. One-day resident parking permit. Special one-day permits
shall be available to residents only for $5, but under no circumstances
shall there be any refund for a one-day parking permit once the same
has been issued to the applicant. The Board of Trustees is permitted
to adjust this charge from time to time through resolution.

An appropriate resident parking permit shall
be issued to residents of the Village, setting forth thereon the following
rules and regulations with respect to commuter parking in municipal
fields:
A. Parking time limit. Vehicles parked more than 24 consecutive
hours in the commuter area may be ordered removed by the Board of
Trustees.
B. Commercial vehicles prohibited. No commercial vehicles
will be permitted to park in the commuter parking area.
C. Separate permits required. Each motor vehicle shall
have an individual parking permit.
D. Designation of parking period. Parking of motor vehicles
in the commuter parking area shall be limited to a period designated
by the Board of Trustees, and such period shall be appropriately posted
in the parking area.
The parking of motor vehicles in the shoppers'
parking area shall be limited to a period of two or three hours, and
appropriate signs shall be erected to that effect.
No automobile or other vehicle shall be parked
or permitted to stand in any traffic lane or driveway in any parking
field maintained by the Village.
No truck or other commercial vehicle shall be
permitted to park within any parking field maintained by the Village
at any time, except such incidental parking for the purpose of loading
or unloading that is of a temporary nature during normal business
hours.

A. General: resident commuter, merchant and nonresident

(1) It shall be unlawful for any person, corporation,
employee or other legal entity to park in certain designated areas
in the Village of Massapequa Park without first having obtained a
permit from the Village Administrator of the Incorporated Village
of Massapequa Park.
(2) Applications for such permits shall be made in writing
to the Village Administrator on the form provided therefor, and such
application must be signed by the applicant.
(3) Upon receipt of the required application for a parking
permit, the Village Administrator or any other person so empowered
shall inspect said application and, based upon his findings resulting
from such inspection, decide whether to issue a permit or deny the
application.
(4) It shall be unlawful for any person, firm, corporation
or other legal entity receiving or eligible to receive a parking permit
from the Village of Massapequa Park to give, transfer or dispose of
said parking permit in any manner whatsoever to anyone. Said parking
permit is not transferable.
(5) It shall be unlawful and a violation for any person
to obtain a parking permit under false pretenses or make false, fraudulent
or inaccurate statements in any application to obtain said parking
permit or use said parking permit in any unauthorized or illegal manner.
(6) Receipt by any person of a parking permit issued by
the Village of Massapequa Park shall subject such recipient to the
jurisdiction of the Village Court of Massapequa Park.
(7) Any person violating this article shall have his or
her parking permit revoked for the balance of the particular year
in which the violation occurred, and that person shall be automatically
ineligible to make application for a parking permit for an additional
period of two years thereafter from the last day of the year in which
the violation occurred, and such person or persons shall be liable
for a mandatory minimum fine of $100 for every violation of this article.
B. Merchant parking permits.
(1) Upon receipt of the required application for a parking
permit, the Village Administrator or any other person so empowered
shall inspect said application and place of employment and, based
upon his findings resulting from such inspection, decide whether to
issue a permit or deny the application.
(2) The merchant/employer must notify the Village of Massapequa
Park, in writing, within 10 days after the termination of the employment
of any employee of his firm or establishment who received a parking
permit from the Incorporated Village of Massapequa Park and where
the expiration date of such parking permit has not elapsed.
(3) If any merchant/employer fails to notify the Village, in writing, of the termination of employment of any employee, as set forth in Subsection
B(2), who has terminated his employment, and said parking permit is utilized by any unauthorized person or persons, that employer shall be guilty of a violation of this article and shall be subjected to a fine, and the Village of Massapequa Park shall have the right to confiscate the parking permit of the merchant/employer, if one was so issued to him, or to take any other action the Village deems appropriate against said employer.
(4) Any employee of a merchant or the merchant/employer
who receives a valid parking permit from the Village of Massapequa
Park shall only be allowed to park his motor vehicle in areas designated
for merchants or in areas designated for twelve-hour parking.
(5) It shall be unlawful for any employee of a merchant,
a merchant/employer or any other person to allow any other person
to use his parking permit, regardless of the fact that said employee/employer
is actively employed at the business premises set forth in the application
to the Village.
(6) To ensure this responsibility, simultaneously with
the filing of an application for a parking permit the merchant/employer
and employee shall execute an affidavit of responsibility. Such affidavit
shall include but not be limited to the permanent addresses of the
merchant/employer and employee where summonses or notices to be complied
with regarding the provisions of this article and all other applicable
laws maybe served upon them.
(7) Areas established as merchant/employee parking areas
shall be located within the municipal parking fields and shall be
properly signed as authorized by the Board of Trustees. Said area
shall be limited to the parking of cars by nonresident employees of
merchants in the Village.
