City of Middletown, NY Article IX Certificate of Occupancy

§ 193-34 Application.

A. It shall be unlawful to use or permit the use of any building or premises or part thereof hereafter created, erected, reconstructed or enlarged, or of any building or premises or part thereof hereafter changed or converted to a different use, until a certificate of occupancy shall have been issued therefor by the Commissioner of Public Works.

B. The owner or his representative may apply for a certificate of occupancy when the building is completed. If the building is found to have been constructed in accordance with the provisions of this code, the Commissioner of Public Works shall issue a certificate of occupancy therefor, within 10 days of date of notification.

§ 193-35 Temporary certificate of occupancy.

Buildings or structures, except private residences, shall not be occupied until a certificate of occupancy has been granted, except that the Commissioner of Public Works may issue a temporary certificate of occupancy for any part thereof.

§ 193-36 Information on certificate of occupancy.

The certificate of occupancy shall state briefly location, occupancy, construction type, number of occupants and permissible live load on floors, or any part thereof.
