A. 
The names of the swimming pools are "War Veterans Memorial Pool," and "Sproat Street Pool," and "Maple Hill Pool."

B. 
The Recreation Commission of the City of Middletown, New York, be and is hereby authorized and directed to operate and maintain City-owned swimming pools in accordance with the laws and ordinances of the City of Middletown and the State of New York.
C. 
The Recreation Commission is authorized to schedule hours for swimming pools.
D. 
The Recreation Commission is authorized to set charges for pools subject to Common Council approval.
E. 
The Recreation Commission is authorized to hire personnel for pools subject to the salary schedule established by the Board of Estimate and Apportionment.
A. 
Application for use of facilities must be made one week in advance of desired date.
B. 
No guaranty is to be paid to an opposing team unless permission is granted by the Recreation Commission.
C. 
If a collection is taken, it must be understood that all money, except expenses allowed by the Superintendent of Recreation, shall be turned over to the Treasurer and may be expended at the direction of the Recreation Commission for the furtherance of recreation in the City of Middletown, with the approval of the Common Council.

D. 
Rental fee; special permission; when required.
(1) 
If there is to be a definite charge for any event, a rental fee will be required. Such fees shall be determined by the Recreation Commission, subject to the approval of the Common Council.
(2) 
For any event other than a sporting event, special permission must be secured from the Recreation Commission.
E. 
Organized teams and leagues are required to submit a financial report at the close of the season to the Superintendent of Recreation.[1]

A. 
Use of all City park property, including but not limited to athletic fields and park pavilions, is subject to authorization by the Middletown Recreation Commission, as conveyed through permit approval by the Superintendent of Recreation. Notwithstanding the foregoing or anything else contained in this § 348-12 or this chapter, use of the City parks known as the Run For Downtown Park (R4DT Park), John F. Degnan Square, Jerry's Park, Wallace Park, Erie Way Park and 116 North Street Park is subject to authorization and approval by the City of Middletown Office of Economic and Community Development, in cooperation with the City of Middletown Business Improvement District.

B. 
Authorized use of all City park property is by permit only, and such permit must be applied for at the Department of Recreation and Parks office in accordance with departmental rules and regulations.

C. 
All users of the City's skatepark in the Erie Way Park must comply with the rules and regulations described in the appendix to this Chapter 348,[2] as the same may be changed from time to time by the Recreation Commission of the City.

D. 
Unauthorized users, users of the City's skatepark who violate the rules and regulations as set forth in § 348-12C above, and/or users of other City parks who do not comply with general City park rules and regulations, must comply with requests by the Superintendent of Recreation or his or her authorized agent, or requests by any member of the City's Police Department, to cease use of and/or to comply with all rules and regulations and/or to vacate any and all City park property, including but not limited to all athletic fields, the City's skatepark and park pavilions.
E. 
Any person violating the provisions of this § 348-12 shall be guilty of an offense, and any person guilty of such violation shall be liable to a fine which shall not exceed $250, or to imprisonment not exceeding 15 days, or to both such fine and imprisonment.

A. 
Dirt bikes, all-terrain vehicles, snowmobiles and all other off-road vehicles are restricted from use on all City park property.
B. 
Cars, trucks, motorcycles, buses, mopeds and all other properly licensed and registered motor vehicles are only allowed on designated park roads or in designated parking areas during usage and patronage of the park and park services, unless authorized by the Middletown Recreation Commission as conveyed through permit approval by the Superintendent of Recreation and Parks. No overnight parking is permitted. The repair, maintenance or cleaning of motor vehicles in City parks is prohibited, unless specifically authorized by the Superintendent of Recreation and Parks. City fire, police, emergency, maintenance and security vehicles are exempt from these restrictions.

C. 
Any person violating the provisions of this section shall be guilty of an offense, and any person guilty of such violation shall be liable to a fine which shall not exceed $300 in amount, plus the cost of labor and materials for any damages caused to City property, or to imprisonment not exceeding 15 days, or both such fine and imprisonment.

A. 
No alcoholic beverages shall be sold.
B. 
Compliance with the Sanitary Code relating to food-selling places is necessary.
C. 
The Recreation Commission will determine the hours for operating the concessions.
D. 
Only the best grade of food must be sold.
E. 
The successful bidder may sell outside the park building in conformance with rules to be set forth by the Recreation Commission.[1]

F. 
The successful bidder must abide by all terms of the leasing agreement and as follows:
(1) 
The term of the lease shall be one year, beginning June 1.
(2) 
Rental must be paid in advance on the first day of every month.
G. 
Prevailing City prices will be charged for food and beverages sold by the concessionaire.
H. 
The Recreation Commission reserves the right to interpret any and all terms stated above.
