[HISTORY: Adopted by the Board of Trustees of the Village of Sylvan Beach 8-16-1976 as L.L. No. 2-1976. Amendments noted where applicable.]
Pursuant to § 24-0501 of Article 24 of the Environmental Conservation Law, in relation to the regulation, management, protection and conservation of the freshwater wetlands within the Village of Sylvan Beach, the Village of Sylvan Beach hereby adopts and sets forth as its chapter for freshwater wetlands protection the provisions for such Article 24, including the procedures and concepts contained therein, except that the provisions of such Article 24 to the extent authorized shall be administered by the Village of Sylvan Beach as provided herein.
Furthermore, after issuance of the official Freshwater Wetlands Map for the Village of Sylvan Beach or any portion thereof, pursuant to § 24-0301 of said Article, any person desiring to construct on freshwater wetlands as so designated in such map of the regulated activities set forth in § 24-0701, Subdivision 2, of said Article must obtain a permit from the Village Clerk of the Village of Sylvan Beach.
A. 
In granting or denying the permit, the Village Clerk shall be guided by the provisions of § 24-0705.
B. 
Any appeals from the decision of the Village Clerk shall be taken in accordance with the provisions of § 24-1103 of said Article.
There shall be no fee for the applying for or granting of a permit, but the penalties set forth in said Article for a violation thereof constitute a civil penalty as provided in § 71-2303 of Article 71 of the Environmental Conservation Law.
