The purpose of this chapter is to protect the public health, welfare
and safety by regulating the operation, driving and insurance of snowmobiles
within the Village of Sylvan Beach in a manner which will promote their safe
and proper use for recreation and commerce, minimize detrimental effects of
such use on the environment and permit the use of designated streets or highways
and portions thereof; compatible with the use for vehicular and pedestrian
travel and other uses.
This chapter is enacted pursuant to the provisions of the Parks, Recreation
and Historic Preservation Law of the State of New York, Title D.
This chapter shall hereafter be known and cited as the "Village of Sylvan
Beach Snowmobile Law."
No person shall operate a snowmobile on any Village street, highway
or portion thereof unless the Village street, highway or portion thereof is
being used by the snowmobiles for the sole and exclusive purpose of access
to and egress from the lake, adjacent waterways, and/or trails.
In addition to the restrictions set forth in §§ 25.03, 25.05, 25.07 and 25.09 of the Parks, Recreation and Historic Preservation Law, whenever the operation or driving of a snowmobile is permitted on any Village street, highway or portion thereof within the Village its provided by §
107-5 above, the following additional conditions and restrictions are hereby established and shall be applicable to all such snowmobile driving and operation:
A. No person shall operate a snowmobile on any Village street,
highway or portion thereof, between the hours of 3:00 a.m. and 7:00 a.m.
B. No person under the age of 18 years shall operate or
drive a snowmobile on any Village street, highway or portion thereof, unless
he has and possesses on his person a valid New York State snowmobile operator's
certificate in accordance with § 25.19 of the Parks, Recreation
and Historic Preservation Law.
C. Snowmobile equipment shall comply with § 25.17
of the Parks, Recreation and Historic Preservation Law of New York State.
D. No person shall drive or operate a snowmobile in any
manner which creates loud, unnecessary or unusual noise so as to disturb or
interfere with the peace and quiet of other persons, or in any other manner
which constitutes a public nuisance, or annoys, injures or endangers the health,
safety, comfort or repose of the public. Snowmobiles may be operated at special
events approved by the Commissioner, in accordance with § 25.11
of the Parks, Recreation and Historic Preservation Law.
E. The liability insurance provisions of § 25.13
of the Parks, Recreation and Historic Preservation Law of the State of New
York shall be applicable to all snowmobiles driven or operated across, upon
or over any Village sweet, highway or any portion thereof.
F. Every person operating or driving a snowmobile on any
Village street, highway or any portion thereof shall observe strictly all
Village signs, signals and devices and all other applicable rules, regulations
and laws applicable to vehicular traffic as set forth in the Vehicle and Traffic
Law of the State of New York.
G. It shall be unlawful to operate a snowmobile on any Village
street, highway or portion thereof as a rate of speed greater than reasonable
or proper under surrounding circumstances; provided, however, that at no time
shall the speed of a snowmobile within the Village exceed 15 miles per hour.
H. It shall be unlawful to operate a snowmobile upon a public sidewalk or walkway, except that a public sidewalk or walkway may be crossed, if the snowmobile is being operated in accordance with §
107-5 above.
I. Snowmobiles shall travel in single file only and shall
travel on the right side of the road in the same direction as the flow of
traffic as required in § 25.05, Subdivision 8(b), of the Parks,
Recreation and Historic Preservation Law.
J. No snowmobile operators or passengers shall deposit litter
upon the highway or lands adjacent thereto.
K. General courtesy shall be given to all property owners.
Permission shall be obtained from the property owner before crossing private
property in accordance with applicable state law.
Any person violating any of the provisions of this chapter shall be
guilty of a violation and, upon conviction thereof, shall be punishable by
a fine not exceeding $250 for each offense or imprisonment not exceeding 15
days, or both such fine and imprisonment.
No snowmobile shall be operated or driven under the authority hereof
until such time as appropriate traffic and snowmobile control signs or devices
are erected in compliance with the rules and regulations of the New York State
Department of Transportation and/or the Office of Parks, Recreation and Historic
Preservation.
